Time flies as the festive atmosphere thickens. To safeguard public food safety and strengthen intellectual property protection, judges from Xi'an Chang'an District People's Court visited the "Qinchuangyuan Intellectual Property Circuit Trial Point" at Shaanxi Intellectual Property Protection Center on December 16. They conducted circuit trials for four intellectual property infringement cases involving the renowned liquor brand Wuliangye Yibin Co.,Ltd.
Circuit Trial Process: Previously, Wuliangye brand investigators discovered suspected counterfeit products displayed in a tobacco and alcohol store operated by defendant Li during market surveillance. After evidence collection, the case was filed with Chang'an Court. Separately, following a criminal conviction of defendant Zhou for counterfeiting registered trademarks - including some Wuliangye products - the brand initiated civil litigation against Zhou's trademark infringement after the criminal judgment took effect. As both cases involved the same plaintiff and trademark, they were consolidated for trial after consulting involved parties.
Presiding Judge Wang Weijun from the comprehensive tribunal carefully heard arguments from both sides, identified key disputed issues, and oversaw orderly proceedings including evidence presentation, cross-examination, and court debates. The verdict will be announced later.
Pre-trial Mediation: While the two consolidated cases were being heard, two parallel cases progressed outside the courtroom. Wuliangye had additionally sued two specialty stores for unauthorized use of its authorized distributor storefront designs. The defendants acknowledged infringement but disputed compensation amounts.
With both sides expressing mediation willingness, court-appointed mediator Liang Shuming from Shaanxi Intellectual Property Protection Center facilitated pre-trial negotiations. Liang explained typical compensation ranges for similar cases and clarified legal liabilities regarding unauthorized storefront designs, considering factors like infringement severity, evidentiary burdens, and defendants' financial capacities.
Through mediation, both cases reached pre-trial settlements. Under judicial supervision, the agreements were immediately executed on-site after repeated deliberations between parties.
This circuit trial initiative represents Chang'an Court's ongoing efforts to strengthen IP protection and improve the business legal environment. Recently, the court has established expert mediation teams through cooperative frameworks to professionally support innovation industries.
In 2025 alone, Chang'an Court has resolved 191 IP cases through Shaanxi Intellectual Property Protection Center, recovering over 340,000 yuan. Moving forward, the court will deepen collaboration with the provincial IP center to enhance administrative-judicial coordination, forming stronger protection synergies to support high-quality economic development through concrete judicial measures.
