Two Ministries Seek Public Feedback on Revised Catalogue of Technologies Prohibited or Restricted from Export

Deep News10-16

The Ministry of Commerce and the Ministry of Science and Technology have proposed revisions to the Catalogue of Technologies Prohibited or Restricted from Export, adding certain artificial intelligence, biomedicine, and photovoltaic technologies, according to a statement published on the Ministry of Commerce website on October 16.

The revisions are based on the Foreign Trade Law of the People's Republic of China and the Regulations on the Administration of Technology Import and Export. With approval, the draft is now open for public comment, and pre-export registration management will be applied to the relevant technologies in parallel.

Proposed Revisions

The public consultation covers 40 technologies across three fields: artificial intelligence, biomedicine, and photovoltaics. In the artificial intelligence field, 23 technologies are involved, including large models, intelligent agents, computing power clusters, and information processing. Technologies that have already entered the public domain through open-source release, published academic papers, or similar means are not included in the scope of management.

In the biomedicine field, 5 technologies are involved, including cell and gene therapy, small nucleic acid drugs, and pathogenic microorganisms. For outbound licensing models that do not involve transfer of ownership, facilitation measures such as automatic licensing will apply.

In the photovoltaic field, 12 technologies are involved, including polysilicon manufacturing, silicon wafer manufacturing, and cell manufacturing. The scope of technology management also includes key and core equipment that embodies the relevant technologies.

How to Submit Feedback

The public may submit comments between October 16 and November 15, 2026, through the following channels regarding the scope of newly added technologies, indicators, control policies, and facilitation measures: 1. Email: jinxianmulu@mofcom.gov.cn; 2. Fax: 010-65197565; 3. Letter: Security and Control Bureau, Ministry of Commerce, No. 2 East Chang'an Avenue, Beijing, Postal Code: 100731. Please indicate "Public Consultation on the Catalogue of Technologies Prohibited or Restricted from Export" in the subject line of emails, on the first page of faxes, and on envelopes. When submitting comments, please provide the contact person, affiliated organization, and contact information. Comments submitted in the name of an organization must be stamped with the organization's official seal.

Pre-Export Registration Requirements

(1) From the date of publication of this announcement until the date the revised Catalogue of Technologies Prohibited or Restricted from Export is formally implemented, technology export operators must register with the Technology Trade Management Information Application on the Ministry of Commerce's unified business system platform (https://ecomp.mofcom.gov.cn) before exporting any technology listed in the annex to this announcement. Exports that have already begun but not yet been completed fall within the scope of registration.

(2) Export situations requiring registration include: 1. Transfer of technology ownership to overseas parties, such as intellectual property transfers; 2. Licensing of domestic technology for overseas use, such as intellectual property licensing; 3. Change of the owner or actual controller of domestic technology to an overseas entity; 4. Other situations explicitly required for registration by the Ministry of Commerce through notices or other means.

(3) The information to be registered mainly includes: basic information of the technology export operator and the technology recipient, the destination country or region, the technology to be exported and its intended use, and the estimated export value of the technology. If multiple technologies are to be exported to the same recipient in a single transaction, they may be combined in one form; in other situations, separate forms should generally be used.
