Biwin Storage Technology Co.,Ltd. (688525.SH) announced that it recently received a Notice to Respond to a Lawsuit and a Statement of Claim from the Nanjing Intermediate People's Court in Jiangsu Province. The plaintiff, Emtier Company, has filed two separate lawsuits against the company and related parties over alleged invention patent infringements. In both cases covered by this announcement, the plaintiff is seeking 25 million yuan in damages and reasonable expenses per case, amounting to a total claim of 50 million yuan.
According to verification, Emtier Company is a joint venture established by Memory Technology LLC (MTL), a U.S.-based firm, and Shenzhen AnjieCun Electronics Co., Ltd. MTL is identified in patent litigation databases, such as the Unified Patents Portal, as a Patent Assertion Entity—a company that primarily generates revenue through patent licensing or litigation. Shenzhen AnjieCun Electronics Co., Ltd. is a wholly-owned subsidiary of Shenzhen Longsys Electronics Co.,Ltd., referred to as Longsys.
Biwin Storage is currently engaged in active licensing negotiations regarding a patent portfolio held by MTL. During the negotiation process, ownership of a small number of patents within the portfolio was transferred to Emtier Company, the plaintiff in the two aforementioned cases. In September 2025, Emtier initiated patent infringement lawsuits against the company based on two patents from the same portfolio. The company disclosed this information in an announcement dated September 20, 2025, titled "Announcement on Receipt of Dismissal Ruling and Related Litigation." The first hearings for these two cases took place on April 2, 2026, and April 3, 2026, respectively, and the proceedings are currently ongoing.
Recently, the company received notification that Emtier Company has once again filed new lawsuits against the company, this time based on two additional patents from the same patent portfolio. After a preliminary assessment, the company believes that these lawsuits will not have a significant adverse impact on its production, operations, or financial condition.
