In response to widespread concerns over the negative impacts of large-scale data centers that support the artificial intelligence industry, New York Governor Kathy Hochul is set to implement the first statewide moratorium on the construction of major data centers.
Governor Hochul will sign an executive order on Tuesday to formally enact this measure. The approval process for permits to build large data centers across the state will be suspended for up to one year. During this period, state officials will develop a regulatory framework to comprehensively address issues related to energy consumption and the environment.
Governor Hochul stated, "The surge in data center construction is driving up utility bills for residents, consuming natural resources, and creating significant uncertainty for New Yorkers. I have a responsibility to take proactive action and lead in solving these problems. New York will be the first to establish the nation's strictest standards for data center construction, ensuring that while businesses grow and thrive in our state, local communities also share in the benefits of that growth."
The moratorium is likely to remain in effect until after the gubernatorial election in November. The policy has been in the works since last month when initial reports indicated the governor was considering an executive order to halt new data center approvals. The suspension will not affect projects that have already received their construction permits.
Governor Hochul's office indicated that certain projects may be exempt. Data centers with generally lower energy consumption that serve scientific research, education, and healthcare sectors will not be subject to the approval pause.
The governor also plans to push for the elimination of sales tax incentives for data centers when state legislators return to Albany in January. This measure would require legislative action by the state assembly to be enacted.
In June, the Democrat-controlled New York State Assembly passed a one-year moratorium on data center construction before concluding its six-month session. It remains unclear whether Governor Hochul will veto this legislative bill.
The proposed moratorium has faced opposition from AI companies, industry advocates, data center developers, and labor unions. Governor Hochul had previously expressed skepticism about a blanket statewide ban, favoring a more localized approach that respects local decision-making authority.
As the data center issue has become a focal point for both major political parties, the pause policy introduced by this moderate Democratic governor could prompt other states across the nation to adopt similar regulatory measures.
Governors across the United States are grappling with an increasingly complex challenge: balancing the desire to seize the economic opportunities presented by the AI boom with the growing number of local-level bans on data center construction. Governor Hochul's executive order represents a significant step in confronting this very contradiction.
