The jury determined that Meta and its YouTube platform were aware their designs were harmful, yet users were largely unaware of the dangers, and the companies failed to provide adequate warnings as responsible platforms should. The jury also awarded $6 million in compensatory and punitive damages to the plaintiff, a 20-year-old woman identified in court documents as K.G.M., and her mother, Karen. Both Alphabet and Meta have announced plans to appeal.
This case is viewed as a potential watershed moment, as it is one of thousands of similar lawsuits filed across the United States by parents, school districts, and state governments against the tech giants. Experts suggest the appeals process could take months and will likely involve debates over free speech protections, potentially reaching the U.S. Supreme Court. A victory for the plaintiffs at the Supreme Court would be a devastating blow to Meta and Alphabet and trigger significant debate over online free speech. Conversely, a win for the tech companies would likely block the legal strategy employed by the plaintiffs' attorneys in this case.
The significance of this social media addiction lawsuit lies in its role as a potential precedent for future litigation against Meta, Alphabet, and similar companies like TikTok and Snap Inc. The lawsuit, case number JCCP 5255, alleges that K.G.M.'s use of social media beginning at age 10 led to a "dangerous dependence on the tech companies' products," resulting in anxiety, depression, self-harm, and body dysmorphic disorder.
Historically, critics have focused on the harmful content hosted on social platforms. However, Section 230 of the U.S. Communications Decency Act shields internet companies from liability for content posted by users and protects them when they act in "good faith" to moderate content deemed objectionable. This law has drawn bipartisan criticism: Republicans argue it allows tech companies to censor conservative voices, while Democrats believe it fosters the spread of misinformation. "While we might hope this encourages tech companies to act more responsibly, what would that mean in practice? He added, "I worry that looking back at the early 21st century, we may怀念 an internet environment that was far freer than what we might see in the next five to ten years."
Columbia Law School professor Eric Talley believes the question of whether Section 230 applies to this case may ultimately push it to the Supreme Court. "This is a novel breakthrough in the plaintiffs' legal strategy... a deliberate attempt to circumvent Section 230's liability shield for content," Talley stated. He further noted, "Under federal law, this attempt to bypass Section 230 could be deemed invalid. If that happens, similar claims based on this legal logic in California and other states would lose their foundation."
Talley indicated that if Meta and Alphabet lose at the Supreme Court and their platform designs are not protected by Section 230, Congress might amend the law to include such designs. Even if they win, the companies might voluntarily adjust their platform designs in response to the issues raised by the case.
Currently, global regulators are focusing on the link between youth social media use and mental health, placing social platforms under increasing worldwide regulatory pressure. Australia has already prohibited social media use for children under 16, and other countries are reportedly following suit: Brazil has banned features like infinite scroll, while other nations are either implementing outright bans for minors or drafting similar legislation.
Opponents of such bans argue that these restrictions deprive young people of access to online information and beneficial mental health support communities and groups. Furthermore, the bans raise complex issues regarding online privacy, such as whether users mistakenly identified as minors would need to provide government-issued identification for age verification.
As the appeal process begins in Los Angeles and more similar cases advance, the decisions on these issues, among others, will critically shape the future of the online world, though the ultimate outcome remains uncertain.
