Estee Lauder Sues Perfumer Jo Malone and Zara UK for Breach of Contract

American cosmetics giant Estee Lauder has filed a lawsuit against British entrepreneur Jo Malone, her fragrance brand Jo Loves, and the UK operations of Zara, alleging unauthorized use of her name. The legal action was reported on Thursday.

Estee Lauder acquired Malone's namesake fragrance brand in 1999, securing the rights to use her name. Malone departed from the company in 2006 and launched her new perfume brand, Jo Loves, in 2011.

The core of Estee Lauder's complaint, filed on Wednesday, revolves around Jo Loves fragrance products sold by Zara that feature packaging with the "Jo Malone" identifier.

The American group is suing Malone for breach of contract, trademark infringement, and passing off—a term referring to the act of misleading consumers into believing goods or services originate from another company.

Estee Lauder, Inditex (the parent company of Zara), and Jo Loves have not yet responded to requests for comment. Jo Malone could not be immediately reached for a statement.
