Green Critical Minerals (ASX:GCM) lodged a statement of claim seeking more than AU$2 million in damages with the Supreme Court of Western Australia regarding its legal proceedings against Hexagon Energy Materials (ASX:HXG) stemming from an alleged material breach of warranties under an earn-in agreement at the Macintosh Graphite Project in the Northern Territory, according to a Thursday filing with the Australian bourse.
Before proceedings started, the company tried to resolve this dispute via negotiation, but Hexagon ceased meaningful engagement, prompting its subsidiary GCM Graphite's legal redress, the company said in the filing.
Green Critical Minerals' statement alleges that despite several requests, Hexagon has not given unambiguous metallurgical test work or expert opinion supporting its ASX releases, the filing showed.
Hexagon has yet to lodge its defense, Green Critical Minerals said.
