Atlas Arteria (ASX:ALX) said Toll Road Investors Partnership II is appealing the Virginia State Corporation Commission's decision rejecting its request to raise the toll rates on the Dulles Greenway road, according to a Friday filing with the Australian bourse.

Toll Road Investors must file its petition for appeal in the Supreme Court of Virginia within 120 days from the date of the commission's final order, being Jan. 2, 2025, the filing stated.

Atlas Arteria owns 100% of the economic interest in Dulles Greenway through the Toll Road Investors Partnership.

The toll road operator's shares were off almost 1% in recent Friday trade.
