Takeda Pharmaceutical Reportedly Found Liable in Constipation Drug Antitrust Case

Takeda Pharmaceutical (TAK) was found liable by a US jury for using an anticompetitive agreement to delay a generic version of its constipation drug Amitiza, according to media reports Monday.

The verdict, delivered in the US District Court for the District of Massachusetts, stemmed from claims that Takeda and former partner Sucampo Pharmaceuticals entered into a "pay-for-delay" settlement with Par Pharmaceutical that postponed generic competition for years, Reuters reported.

Takeda Pharmaceutical said damages awarded to wholesaler and retailer plaintiffs are subject to automatic trebling under US antitrust law upon entry of judgment.

The company said it plans to appeal the ruling and believes the trial included both legal and evidentiary errors.

"We remain firm in our conviction that the plaintiffs' case lacks merit, and we will vigorously pursue post-trial motions and an appeal," the company said in a statement.

Takeda Pharmaceutical said the jury verdict will not have any impact on its 2025 full year financial results.
