Bunker Hill Mining secured a major legal win after a U.S. federal court threw out the core of Crescent Mine's case while allowing Bunker Hill's primary claims to proceed.
The District Court for Idaho granted summary judgment on multiple key claims, throwing out Crescent's central federal claims under the Comprehensive Environmental Response, Compensation, and Liability Act and rejecting its attempt to force Bunker Hill to drain the mine.
The ruling marks a significant shift in a case that began in 2021 and involves a dispute over responsibility for managing contaminated water.
Bunker Hill Mining, which is working to restart its silver-lead-zinc mine in Idaho's Silver Valley, said the ruling keeps the company on the offensive. The judge allowed Bunker Hill's own CERCLA contribution claim to proceed, preserving the company's effort to recover from Crescent a share of the costs to manage and remediate contaminated water from both companies' mines, Bunker Hill said.
The ruling narrows Crescent's remaining claims to a small set that will proceed to trial, it said.
