Arbutus Biopharma, Genevant sue Pfizer, BioNTech Over Lipid Nanoparticle Patents

Arbutus Biopharma (ABUS) and its licensee Genevant Sciences, a subsidiary of Roivant Sciences (ROIV), said Thursday they have filed three international patent infringement lawsuits against Pfizer (PFE), BioNTech (BNTX) over lipid nanoparticle technology used in mRNA COVID-19 vaccines.

The companies said they are seeking monetary damages and permanent injunctions covering Pfizer-BioNTech's COVID-19 vaccines and other allegedly infringing products.

The new actions expand their existing US patent litigation in New Jersey involving five patents, they said.

Separately, Arbutus said it received about $178 million from Moderna (MRNA) on July 8 as its part of a global patent settlement and expects to receive a dividend from Genevant's parent in Q3.

The company said it plans to return capital to shareholders through share repurchases of up to $230 million starting in Q3.

Arbutus Biopharma shares were 3.7% higher in premarket trading.
