Labcorp to Pay $14.5 Million to Settle False Claims Act Allegations

Labcorp (LH) agreed to pay $14.5 million to resolve allegations that it violated the False Claims Act by submitting false claims to Medicare Part B for medically unnecessary urine drug testing conducted under a testing panel marketed as ToxAssure Comprehensive, the Justice Department said Wednesday.

The Justice Department alleged that from 2018 through 2023, Labcorp billed Medicare for both all-inclusive presumptive testing and the highest-tier definitive testing for the same patient on the same date of service and, in some cases, performed definitive tests without first conducting available presumptive tests.

As part of the settlement, Labcorp admitted, acknowledged and accepted responsibility for certain facts described in the agreement and said it has stopped billing Medicare for the combination of codes used with the ToxAssure Comprehensive panel.

The DOJ said the claims resolved by the settlement are allegations only and that there has been no determination of liability.

Labcorp did not immediately respond to a request for comment from MT Newswires.
