Tivan (ASX:TVN) acknowledged that it unintentionally breached a heritage protection agreement during a 2025 exploration program at the Speewah fluorite project in Western Australia and publicly apologized to the Nganjuwarr Native Title Holders in connection with the agreement, according to a Tuesday Australian bourse filing.
The firm acknowledged that its processes and record-keeping "fell short of what was required" under the agreement and it accepted full responsibility for the breaches. It said that it committed to taking all necessary steps to ensure the non-compliance is not repeated and that it has undertaken a comprehensive review of its internal processes and has implemented strengthened procedures.
Tivan, the Nganjuwarr Native Title Holders and their prescribed body corporate, Giliwinggin Aboriginal Corporation, are negotiating a native title agreement which is expected to include a cultural heritage management plan that will operate in place of the existing agreement.
Tivan will pay AU$50,000 as compensation for the non-compliance in accordance with a deed of release executed by Tivan and Giliwinggin Aboriginal Corporation.
Its shares jumped 5% in recent trading on Tuesday.
