Liberty Global (LBTYA), Telefonica (TEF) and InfraVia, as owners of Nexfibre, are yet to submit a remedies package in response to the UK Competition and Markets Authority's interim report on Nexfibre's proposed acquisition of Netomnia, the Nexfibre owners told MT Newswires Tuesday.
In its interim report released earlier this month, the CMA said the planned transaction could substantially reduce competition in the market. The Nexfibre shareholders told MT Newswires that the report is "fundamentally flawed," based on "counterfactuals" that do not reflect the UK's current fiber market.
"There is no remedies package that can address the CMA's current counterfactuals, and on that basis we have not submitted one," the companies added.
InfraVia, Telefonica and Liberty Global also said they remain open to engage with the CMA "once the counterfactuals reflect the reality of the market."
On the other hand, a CMA spokesperson told MT Newswires that the regulator is open to feedback on its interim report and will issue its final decision after assessing such feedback.
