Apple said Spotify wants “all the benefits of the App Store but don’t think they should have to pay anything for that,” by choosing to object to its 15-30% commission on in-app payments for streaming apps.\nApple isn’t currently facing any antitrust charges from government officials in the U.S. and such a lawsuit may never materialize, though the Department of Justice wasreportedly granted oversight of the company’s competitive practices in 2019. But even if the government declines to press charges, recent actions in Congress, state legislatures and in private lawsuits demonstrate a significant shift in the American public’s sentiment toward Apple and the tech industry at large.\nWhen the commissionslapped its first record competition fineagainstGooglein 2017, it wasn’t yet clear that the U.S. might be ready to move on from its once-cozy relationship with its booming tech industry. But in 2018, on the heels of the revelations of howFacebookuser data was used by analytics company Cambridge Analytica during the 2016 election, and increasing questions about how tech platforms can impact American democracy, that seemed to change.\nNow, as Europe continues to move forward with its probe into Apple, the U.S. no longer seems to be so far behind.\nHere’s where Apple stands to face risk of antitrust action or regulation in the U.S.:\nDOJ\nThe DOJ has already moved forward with a massive lawsuit against Google, so it could take some time if it decides to ramp up a probe into Apple. Though the DOJ’s Antitrust Division took on oversight authority of Apple in a 2019 agreement with the FTC, according to aWall Street Journal report, the Google investigation has seemed to take priority.\nStill, then-Attorney General Bill Barr announced later that year that the DOJ wouldconduct a broad antitrust review of Big Tech companies.\nAny action from the DOJ or state enforcers would take the form of a settlement or lawsuit, which would put Apple’s fate in the hands of the courts.\nPrivate lawsuits\nApple’s most immediate challenge in the U.S. has come from private companies bringing antitrust charges against its business in court.\nThe most notable of these lawsuits isfrom Fortnite-maker Epic Games, which is set to begin its trial on Monday. Epic filed its lawsuit with a PR blitz afterchallenging Apple’s in-app payment feeby advertising in its app an alternative, cheaper way to buy character outfits from Epic directly, violating Apple’s rules. That prompted Apple to remove Fortnite from its App Store. Epic filed the suit shortly after and Applefiled counterclaimsagainst Epic for allegedly breaching its contract.\n“Although Epic portrays itself as a modern corporate Robin Hood, in reality it is a multi-billion dollar enterprise that simply wants to pay nothing for the tremendous value it derives from the App Store,” Apple said in a filing with the District Court for the Northern District of California in September.\nCongress\nJust last week,several app-makers testified before the Senate Judiciary subcommittee on antitrust about the alleged anti-competitive harms they’ve facedfrom restrictions on both Apple and Google’s app stores.\nRepresentatives from Apple and Google told lawmakers they simply charge for the technology and the work they put into running the app stores, which have significantly lowered distribution costs for app developers over the years.\nBut witnesses from Tinder-ownerMatch Group, item-tracking device-maker Tile and Spotify painted a different picture.\n“We’re all afraid,” Match Group chief legal officer Jared Sine testified of the platforms’ broad power over their businesses.\nThe witnesses discussed the seemingly arbitrary nature by which Apple allegedly enforces its App Store rules. Spotify’s legal chief claimed Apple has threatened retaliation on numerous occasions and Tile’s top lawyer said Apple denied access to a key feature that wouldimprove their object-tracking product, before utilizing it for Apple’s own rival gadget,called AirTag.\nTile said that while Apple now makes the feature available for third-party developers to incorporate, accessing it would mean handing over a significant amount of data and control to Apple. Apple’s representative said its product is different from Tile’s and opening the feature in question will encourage further competition in the space.\nSenators at the hearing seemed receptive to the app developers’ complaints, which build on earlier claims made before House lawmakers. The House Judiciary subcommittee on antitrust found in a more than year-long probe thatAmazon, Apple, Facebook and Googleall hold monopoly power, and lawmakers are currently crafting bills to enable stronger antitrust enforcement of digital markets.\nState Legislatures\nSeveral state legislatures have beenconsidering bills that would require platforms like Apple and Google to allow app-makers to use their own payment processing systems. Here’s what four of them told CNBC after the report:\nDan Ives, senior equity research analyst for technology at Wedbush Securities, said this could be a “historic year” for Apple:\n“If you looked up ‘blowout earnings’ in the dictionary, it would be Apple’s March quarter. I mean, this is what I almost say is the dream scenario for the bulls in terms of what you see on iPhones, services [and] of course on the buyback as well. … Many are skeptical about the supercycle. You look at this quarter. This [is] what I believe is the exclamation mark that the supercycle is alive and well. This looks like this is going to be Apple’s historic year where they’ll break 231 million iPhones. I think right now, this is the catalyst to get this to 175, $200. This is really, in my opinion, probably the best quarter I’ve seen from Apple in the last 18-24 months.”\nMike Santoli, CNBC’s senior markets commentator, said one big risk to Apple is the “perception” of pulled-forward demand:\n\"The company itself says it does not expect this kind of run rate for iPad and Mac. Now, phones, different story. We don't know if that's going to continue to play out. And then it's what multiple do you put on it? [A] $90 billion incremental stock buyback I think is pretty much in the zone. To me, it seems like a pretty stingy dividend increase, but they're really … emphasizing the buyback. So, the story is intact, it's always just been about how far do we extrapolate this type of performance? We already are paying 29 times currently expected earnings. How much can those earnings go up to bolster that valuation?\"\nCEO of Superhuman and Apple shareholder Rahul Vohra saw several positive catalysts for the company:\n\"I actually look more towards the Mac and the iPad businesses. We saw through 2020 and, as we all expected, Q2 as well, extremely strong growth in those businesses fueled primarily by remote work. And I think the question we're all asking is will this continue? I think we will continue to see these businesses grow in 2021. The new iMacs are jaw-droppingly beautiful. The new iPads are real laptop replacements. And remote work will keep these devices as well as iPhone in high demand. And actually, at Superhuman, we just completed a study that underlines all of this. It turns out that 51% of U.S. remote workers are now buying productivity tools out of their own pockets and a further 17% more still plan to do so.\"\nGene Munster, managing partner at Loup Ventures, said Apple's valuation is still \"at the lower end\" considering the \"transformative tech\" it creates:\n\"Some incredible growth years are still ahead of this company. Everything from hardware as a service — we talk about this. We refer to it as a 360 bundle, to be able to rent a Mac, an iPhone, your services all together. We think that's coming in the next couple of years. We're going to hear likely about mixed reality, those goggles at the developers' conference. That's part of the metaverse. That's a big opportunity. And then remains what they do around automotive. That's a, depending on how you look at the addressable market, multitrillion-dollar addressable market. So, I would say this: let's just take a quick step back. This was a good quarter. It was a great quarter. I don't know what the adjective is. It's probably as good of a quarter, as much upside, as I've seen in a decade from Apple. What I can say is that the naysayers will say it's not sustainable, and I understand that, but that has been a well-traveled theme around this and Apple year in, year out, delivers, and I think they'll continue. I'll leave with this thought: I have a prediction that Apple's going to be the top-performing FAANG for 2021. I am well behindGoogleright now — I think they're up 30-40%. Apple's just up fractionally. And I continue to stand behind that. The president addresses a joint session of Congress Wednesday evening.It’s a huge week for earnings with about a third of the S&P 500 reporting, including Big Tech names, such as Apple,Microsoft,Alphabet and Amazon.As many have already done, firms like Boeing, Ford,Caterpillar and McDonald’s, are likely to detail cost pressures they are facing from rising materials and transportation costs and supply chain disruptions.At the same time, the Fed is expected to defend its policy of letting inflation run hot, while assuring markets it sees the pick-up in prices as only temporary. The central bank meets on Tuesday and Wednesday.The central bank takes the main stage“I think the Fed would like not to be a feature next week, but the Fed will be forced from the background because of concerns about inflation,” said Diane Swonk, chief economist at Grant Thornton.The central bank is not expected to make any policy moves, but Fed Chairman Jerome Powell’s press briefing following the meeting Wednesday will be closely watched.So far, the barrage of earnings news has been positive, with 86% of companies reporting earnings beats. Corporate profits are expected to be up about 33.9% for the first quarter, based on estimates and actual reports, according to Refinitiv. Revenues are about 9.9% higher.There is important inflation data Friday when the Fed’s preferred inflation gauge is reported.The personal consumption expenditure report is expected to show a 1.8% rise in core inflation, still below the Fed’s target of 2%. Other data releases include the first-quarter gross domestic product on Thursday, which is expected to have grown by 6.5%, according to Dow Jones.“I think the Fed has no urgency to shift monetary policy at this point,” said Ian Lyngen, head of U.S. rates strategy at BMO. “The Fed needs to acknowledge that the data is improving. We had a strong first quarter.”“The Fed needs to acknowledge that but at the same time they’re keeping extremely accommodative policy in place, so they’ll have to make a note to the fact that the easy policy is warranted,” he said.Lyngen said the Fed will likely point to continued concerns about the pandemic globally as a potential risk to the economic recovery.Powell is also expected to once more explain that the Fed will let inflation rise above its 2% target for a period of time before it raises rates so that the economy can have more time to heal. “It’s going to be a challenge for the Fed,” said Swonk.The base effects for the next several months will make inflation appear to have jumped sharply because of the comparison to a weak period last year. The consumer price index for April could be above 3%, compared to 2.6% last month, Swonk added.“The Fed is trying to let a lot more people get out onto the dance floor before it calls ‘last call,’” she said. “Really what Powell has been saying since day one is if we take care of people on the margins and bring them back into the labor force, the rest will take care of itself.”Stocks were slightly lower in the past week, and Treasury yields held at lower levels. The 10-year yield,which moves opposite price, was at 1.55% Friday.The S&P 500was down 0.1%, ending the week at 4,180, while Nasdaq Composite was down nearly 0.3% at 14,016. The Dow was off just shy of 0.5% at 34,043.Tax hike prospectsStocks were hit hard on Thursday when after a news report said that Biden is expected to propose a capital gains tax rate of 39.6% for people earning more than $1 million a year.Combined with the 3.8% net investment income tax, the new levy would more than double the long term capital gains rate of 20% or the richest Americans.Strategists said Biden is expected to propose raising the income tax rate for those earning more than $400,000.“I think a lot of people are starting to price in the risk there going to be a significant increase in both corporate and capital gains taxes,” said Lyngen.So far, companies have not provided much in the way of commentary on the proposed hike in corporate taxes to 28% from 21% but they have been talking about other costs.David Bianco, chief investment strategist for the Americas at DWS, said he expects larger companies will do better dealing with supply chain constraints than smaller ones. Big Tech is also likely to fare better during the semiconductor shortage than auto makers, which have already announced production shutdowns, he said.“Next week is tech week. I think we’re going to get down on our knees and just be in awe of their business models and their ability to grow at a behemoth scale,” Bianco said.He said he’s not in favor of Wall Street’s popular trade into cyclicals and out of growth. He still favors growth.“We’re overweight equities really because we’re concerned about rising interest rates,” Bianco said. “I’m not bullish in that I expect the market to rise that much from here.”“We stuck with growth and dug deeper into bond substitutes, utilities, staples, real estate,” he said, adding he is underweight industrials, energy and materials. “Energy is doomed. It’s being nationalized via regulation. I do like industrials, they are well-run companies, but I do think infrastructure spending expectations for classic infrastructure are too high.”He also said industrials are good businesses, but the stocks have become overvalued.Bianco said he likes big box stores, but smaller retailers are facing big challenges that were already impacting them prior to Covid. He also finds small biotech firms attractive.“I like healthcare stocks. Those valuations are reasonable. People have been paranoid about politicians beating on them since 1992. Simply put, CEO Mike Roman's task is to use the company's substantive earnings and free cash flow (FCF) to&nbsp;turn around 3M's performance.</p>\n<p>The company generates bundles of earnings before interest, depreciation, amortization (EBITDA), and FCF. Its price-to-FCF valuation looks cheap, especially compared to a multi-industry peer like <b>Illinois Tool Works</b>, trading at nearly 28 times its FCF.</p>\n<p class=\"t-img-caption\"><img src=\"https://static.tigerbbs.com/c6ecd09a228dcf915ce4d3bbf06dff77\" tg-width=\"720\" tg-height=\"387\" referrerpolicy=\"no-referrer\"><span>Data by YCharts. TTM = trailing 12 months.</span></p>\n<h2>What's been going wrong</h2>\n<p>The reason 3M trades at a discount to Illinois Tool Works comes down to a combination of its potential legal liability for PFAS&nbsp;chemicals and its underperformance on earnings relative to management expectations.</p>\n<p>3M operates out of four segments. The safety and industrial segment and the transportation and electronics segment have significant exposure to the industrial economy and automotive industry. And given weak end-market conditions in recent years, it's understandable if they have performed poorly. However, what isn't forgivable is that the <i>less cyclical </i>segments, namely healthcare and consumer, have disappointed the most.</p>\n<p>For example, back on investor day in late 2018, then-CFO Nick Gangestad outlined expectations for 2019-2023 total company organic revenue growth of 3% to 5% a year, with the healthcare segment up 4% to 6% and the consumer segment up 2% to 4%.</p>\n<p>While 2020's performance is understandable in the context of the pandemic, the performance in 2018-2019 is disappointing. Both relatively small businesses.</p>\n<h2>What 3M has been doing about it</h2>\n<p>The good news is that Roman is taking action, in particular with the healthcare segment. The non-core drug delivery business was sold for $650 million in 2020., On the acquisition front, 3M bought M*Modal's health information systems business for $1 billion in early 2019. Management followed up by buying Acelity (specializing in advanced and surgical wound care) for $6.7 billion at the end of 2019. Also, the food safety business is rumored to be another business that management is willing to sell.</p>\n<p>On top of the acquisitions and divestment activity, Roman has restructured the company from five business segments to four and streamlined the operation by cutting positions. Also, he has changed the company's business model by allowing 3M's business groups to run on a global basis rather than being operated on a country-by-country basis.</p>\n<p class=\"t-img-caption\"><img src=\"https://static.tigerbbs.com/a89ca2eece43ee0d5bf19e320480af6a\" tg-width=\"700\" tg-height=\"466\" referrerpolicy=\"no-referrer\"><span>Image source: Getty Images</span></p>\n<p>In case there are any doubts that turning around the healthcare segment wasn't the main focus, it's not a coincidence that the former CFO of <b>GE</b>'s (NYSE: GE) Healthcare business, Monish Patolawala, was appointed as 3M's CFO in July 2020.</p>\n<h2>It's time for 3M to deliver</h2>\n<p>With all these actions in place, investors are entitled to expect improvements to start showing through in 2021, starting with the upcoming first-quarter earnings report on April 27.</p>\n<p>Unfortunately, the company faced headwinds in the first quarter, and they are likely to make its earnings report messy. For example, automotive production (a major end market for 3M across its industrial segments) has been hit by the semiconductor shortage, and rising raw material costs are eating into profit margins, according to Patolawala. Meanwhile, healthcare is likely to be impacted by the pandemic in the first quarter.</p>\n<p>On the other hand, the recovery in the industrial economy is taking shape in the U.S., and many of 3M's end markets will be strengthening. Also, since management has articulated that there hasn't been an inventory buildup by its customers, it might kick in at some point in 2021 as the economy recovers.</p>\n<h2>What to expect</h2>\n<p>It's unclear what 3M will report, and the market could be disappointed if it doesn't raise guidance in an environment where many of its peers may well do so. The bad news: There's little hard evidence that the restructuring is having a significant impact, and the upcoming first-quarter earnings report on April 27 might confuse more than it clarifies.\nImage source: Getty Images.\nThe case for buying 3M stock\nThe investment thesis is not based on the company that 3M is now, but on what it could become. Simply put, CEO Mike Roman's task is to use the company's substantive earnings and free cash flow (FCF) to turn around 3M's performance.\nThe company generates bundles of earnings before interest, depreciation, amortization (EBITDA), and FCF. Its price-to-FCF valuation looks cheap, especially compared to a multi-industry peer like Illinois Tool Works, trading at nearly 28 times its FCF.\nData by YCharts. TTM = trailing 12 months.\nWhat's been going wrong\nThe reason 3M trades at a discount to Illinois Tool Works comes down to a combination of its potential legal liability for PFAS chemicals and its underperformance on earnings relative to management expectations.\n3M operates out of four segments. The safety and industrial segment and the transportation and electronics segment have significant exposure to the industrial economy and automotive industry. And given weak end-market conditions in recent years, it's understandable if they have performed poorly. However, what isn't forgivable is that the less cyclical segments, namely healthcare and consumer, have disappointed the most.\nFor example, back on investor day in late 2018, then-CFO Nick Gangestad outlined expectations for 2019-2023 total company organic revenue growth of 3% to 5% a year, with the healthcare segment up 4% to 6% and the consumer segment up 2% to 4%.\nWhile 2020's performance is understandable in the context of the pandemic, the performance in 2018-2019 is disappointing. Both relatively small businesses.\nWhat 3M has been doing about it\nThe good news is that Roman is taking action, in particular with the healthcare segment. The non-core drug delivery business was sold for $650 million in 2020., On the acquisition front, 3M bought M*Modal's health information systems business for $1 billion in early 2019. Management followed up by buying Acelity (specializing in advanced and surgical wound care) for $6.7 billion at the end of 2019. Also, the food safety business is rumored to be another business that management is willing to sell.\nOn top of the acquisitions and divestment activity, Roman has restructured the company from five business segments to four and streamlined the operation by cutting positions. Also, he has changed the company's business model by allowing 3M's business groups to run on a global basis rather than being operated on a country-by-country basis.\nImage source: Getty Images\nIn case there are any doubts that turning around the healthcare segment wasn't the main focus, it's not a coincidence that the former CFO of GE's (NYSE: GE) Healthcare business, Monish Patolawala, was appointed as 3M's CFO in July 2020.\nIt's time for 3M to deliver\nWith all these actions in place, investors are entitled to expect improvements to start showing through in 2021, starting with the upcoming first-quarter earnings report on April 27.\nUnfortunately, the company faced headwinds in the first quarter, and they are likely to make its earnings report messy. For example, automotive production (a major end market for 3M across its industrial segments) has been hit by the semiconductor shortage, and rising raw material costs are eating into profit margins, according to Patolawala. Meanwhile, healthcare is likely to be impacted by the pandemic in the first quarter.\nOn the other hand, the recovery in the industrial economy is taking shape in the U.S., and many of 3M's end markets will be strengthening. Also, since management has articulated that there hasn't been an inventory buildup by its customers, it might kick in at some point in 2021 as the economy recovers.\nWhat to expect\nIt's unclear what 3M will report, and the market could be disappointed if it doesn't raise guidance in an environment where many of its peers may well do so. The president addresses a joint session of Congress Wednesday evening.It’s a huge week for earnings with about a third of the S&P 500 reporting, including Big Tech names, such as Apple,Microsoft,Alphabet and Amazon.As many have already done, firms like Boeing, Ford,Caterpillar and McDonald’s, are likely to detail cost pressures they are facing from rising materials and transportation costs and supply chain disruptions.At the same time, the Fed is expected to defend its policy of letting inflation run hot, while assuring markets it sees the pick-up in prices as only temporary. The central bank meets on Tuesday and Wednesday.The central bank takes the main stage“I think the Fed would like not to be a feature next week, but the Fed will be forced from the background because of concerns about inflation,” said Diane Swonk, chief economist at Grant Thornton.The central bank is not expected to make any policy moves, but Fed Chairman Jerome Powell’s press briefing following the meeting Wednesday will be closely watched.So far, the barrage of earnings news has been positive, with 86% of companies reporting earnings beats. Corporate profits are expected to be up about 33.9% for the first quarter, based on estimates and actual reports, according to Refinitiv. Revenues are about 9.9% higher.There is important inflation data Friday when the Fed’s preferred inflation gauge is reported.The personal consumption expenditure report is expected to show a 1.8% rise in core inflation, still below the Fed’s target of 2%. Other data releases include the first-quarter gross domestic product on Thursday, which is expected to have grown by 6.5%, according to Dow Jones.“I think the Fed has no urgency to shift monetary policy at this point,” said Ian Lyngen, head of U.S. rates strategy at BMO. “The Fed needs to acknowledge that the data is improving. We had a strong first quarter.”“The Fed needs to acknowledge that but at the same time they’re keeping extremely accommodative policy in place, so they’ll have to make a note to the fact that the easy policy is warranted,” he said.Lyngen said the Fed will likely point to continued concerns about the pandemic globally as a potential risk to the economic recovery.Powell is also expected to once more explain that the Fed will let inflation rise above its 2% target for a period of time before it raises rates so that the economy can have more time to heal. “It’s going to be a challenge for the Fed,” said Swonk.The base effects for the next several months will make inflation appear to have jumped sharply because of the comparison to a weak period last year. The consumer price index for April could be above 3%, compared to 2.6% last month, Swonk added.“The Fed is trying to let a lot more people get out onto the dance floor before it calls ‘last call,’” she said. “Really what Powell has been saying since day one is if we take care of people on the margins and bring them back into the labor force, the rest will take care of itself.”Stocks were slightly lower in the past week, and Treasury yields held at lower levels. The 10-year yield,which moves opposite price, was at 1.55% Friday.The S&P 500was down 0.1%, ending the week at 4,180, while Nasdaq Composite was down nearly 0.3% at 14,016. The Dow was off just shy of 0.5% at 34,043.Tax hike prospectsStocks were hit hard on Thursday when after a news report said that Biden is expected to propose a capital gains tax rate of 39.6% for people earning more than $1 million a year.Combined with the 3.8% net investment income tax, the new levy would more than double the long term capital gains rate of 20% or the richest Americans.Strategists said Biden is expected to propose raising the income tax rate for those earning more than $400,000.“I think a lot of people are starting to price in the risk there going to be a significant increase in both corporate and capital gains taxes,” said Lyngen.So far, companies have not provided much in the way of commentary on the proposed hike in corporate taxes to 28% from 21% but they have been talking about other costs.David Bianco, chief investment strategist for the Americas at DWS, said he expects larger companies will do better dealing with supply chain constraints than smaller ones. Big Tech is also likely to fare better during the semiconductor shortage than auto makers, which have already announced production shutdowns, he said.“Next week is tech week. I think we’re going to get down on our knees and just be in awe of their business models and their ability to grow at a behemoth scale,” Bianco said.He said he’s not in favor of Wall Street’s popular trade into cyclicals and out of growth. He still favors growth.“We’re overweight equities really because we’re concerned about rising interest rates,” Bianco said. “I’m not bullish in that I expect the market to rise that much from here.”“We stuck with growth and dug deeper into bond substitutes, utilities, staples, real estate,” he said, adding he is underweight industrials, energy and materials. “Energy is doomed. It’s being nationalized via regulation. I do like industrials, they are well-run companies, but I do think infrastructure spending expectations for classic infrastructure are too high.”He also said industrials are good businesses, but the stocks have become overvalued.Bianco said he likes big box stores, but smaller retailers are facing big challenges that were already impacting them prior to Covid. He also finds small biotech firms attractive.“I like healthcare stocks. Those valuations are reasonable. People have been paranoid about politicians beating on them since 1992. Simply put, CEO Mike Roman's task is to use the company's substantive earnings and free cash flow (FCF) to&nbsp;turn around 3M's performance.</p>\n<p>The company generates bundles of earnings before interest, depreciation, amortization (EBITDA), and FCF. Its price-to-FCF valuation looks cheap, especially compared to a multi-industry peer like <b>Illinois Tool Works</b>, trading at nearly 28 times its FCF.</p>\n<p class=\"t-img-caption\"><img src=\"https://static.tigerbbs.com/c6ecd09a228dcf915ce4d3bbf06dff77\" tg-width=\"720\" tg-height=\"387\" referrerpolicy=\"no-referrer\"><span>Data by YCharts. TTM = trailing 12 months.</span></p>\n<h2>What's been going wrong</h2>\n<p>The reason 3M trades at a discount to Illinois Tool Works comes down to a combination of its potential legal liability for PFAS&nbsp;chemicals and its underperformance on earnings relative to management expectations.</p>\n<p>3M operates out of four segments. The safety and industrial segment and the transportation and electronics segment have significant exposure to the industrial economy and automotive industry. And given weak end-market conditions in recent years, it's understandable if they have performed poorly. However, what isn't forgivable is that the <i>less cyclical </i>segments, namely healthcare and consumer, have disappointed the most.</p>\n<p>For example, back on investor day in late 2018, then-CFO Nick Gangestad outlined expectations for 2019-2023 total company organic revenue growth of 3% to 5% a year, with the healthcare segment up 4% to 6% and the consumer segment up 2% to 4%.</p>\n<p>While 2020's performance is understandable in the context of the pandemic, the performance in 2018-2019 is disappointing. And given weak end-market conditions in recent years, it's understandable if they have performed poorly.
