These advantages mean that the company will remain superior in the near term when it comes to profitability and diversity within the EV industry and can best utilize the rapid growth rate the entire industry is expecting.</p>\n<p>The Long-Term Headwinds Haven't Changed</p>\n<p>As I've been highlighting for several months now,Tesla's long-term prospects have dimmedsince other automobile companies like Ford and General Motors (GM) in the United States, NIO (NIO) and others in the Asia-Pacific region and other European and South Korean automobile manufacturers moved up their electrification process timelines. The main reason for this is that these companies have very solid brand recognition, and individuals who have owned these models for years or decades have the option to opt for an electric version of those; they choose those over trying out a new untested model a majority of the time.</p>\n<p>With companies like Ford introducing the all-electric F-150 and others, it's unclear how Tesla can maintain this high growth rate beyond 2024 as these models are expected to hit the streets and begin capturing back market share away from Tesla and other current models. Other factors like Tesla opening up their charging station network to all EV models, as well as a massive capital injection into EV charging stations in the most recent infrastructure spending bill in the United States, will surely help Tesla's income when it charges for the use, but it also helps other companies overcome the main hurdle of widespread adoption - clearing a pathway for more and more EV models to emerge.</p>\n<p>The Short-Term Tailwinds Are Emerging</p>\n<p>Tesla has several near-term tailwinds which will keep way ahead of any competition for the next 12 to 24 months. These mostly all boil down to profitability but also focus on various business model advantages.</p>\n<p>1. A positive profit margin: While other companies are just now beginning to invest in transforming their manufacturing facilities from fossil fuel intake engines to electric vehicle production, Tesla has done this and way more efficiently. Since they've built these from scratch, they've mostly automated the process and thus enjoy a much higher profit margin. Other companies won't see a profit per vehicle for years to come.</p>\n<p>2. Surging battery manufacturing: Although other companies have a mixed position on whether to manufacture their own batteries or set up joint ventures with existing companies, Tesla has been churning out batteries for years and have, as similar with the vehicle manufacturing process, nearly fully automated the process to maximize profits per unit.</p>\n<p>3. International manufacturing: Other companies, thus far, have focused on restructuring and transforming current assembly plants in the United States and will likely take several more years before they do so for other international facilities, which means they will need to spend a fortune shipping these new vehicles around the world to the EMEA and the Asia-Pacific. Tesla, on the other hand, has manufacturing facilities in the United States and in China and is set to open their plant in Germany as well as being in final development stages of an India plant, which will allow them to access a much larger market.</p>\n<p>4. Charging stations advantage: Although the new infrastructure bill in the United States, as well as massive investments in countries like Japan and China, are certain to put in hundreds of thousands of new EV charging stations across the globe, this will take time. So far, only Tesla has a real robust charging network across the world. A recent development, which does have negative elements to it as mentioned earlier, has a positive near term one - they will be raking in net profits from allowing other electric vehicles to charge on their network. This means that they'll likely be profiting from each vehicle their competitors churn out, at least until the scaling up of non-Tesla charging stations takes place.</p>\n<p>5. \"Other Business\" growth rate: While other automobile companies are still spending hand over fist on their other models and products, Tesla enjoys being only in high-growth industries like SolarCity's solar panels and battery sales. As I'll expand on in the next segment, they also don't have near-term or long-term financial obligations from these \"other business\" segments as establishment automobile companies have.</p>\n<p>Balance Sheet Advantages</p>\n<p>Although some elements of their balance sheet advantage are set to help them in the long run as well, they're mostly advantages for the short term since once these other companies begin making a profit from their EV sales - a lot of this will be reversed.</p>\n<p>Tesla's main advantage, as mentioned earlier, is that they're actually raking in cash from each car they sell, allowing them to use that cash to continue and set up more manufacturing facilities and invest in battery technology, solar technology and production increases. This is contrary to other automobile companies which have high financial obligations to their other business segments like pensions and leases. This will further aid the company's overall profit margin, while they don't struggle with such obligations.</p>\n<p>These other companies will need to use profits and cash from their existing legacy business segments to pay for their losses on each vehicle they produce, hurting their overall valuation moving forward.</p>\n<p>Although Tesla has $6.9 billion inlong-term debt, a factor which kept many investors on the sidelines as debt racked up, they currently hold just under $16.3 billion in cash and equivalents, making their net debt position negative. They've been using the cash to pay down their debt as well,reducing their interest expense burdenfrom almost $800 million in 2020 to just over $500 million in 2021. Tesla paid back $15 billion in debt in 2021 for a net debt reduction of $6 billion. There's very little doubt that other automobile companies will be forced to take on more debt to finance increased production and in this raising rate environment, that can snowball.</p>\n<p>Tesla is set to seecash flowof around $10 billion annually whereas a company like Ford has been fluctuating between a net positive and negative cash flow status for the past few years, and that's not expected to change through 2025 as they continue to increase investments in the electrification of their vehicles.</p>\n<p>What About Current Valuation</p>\n<p>Analystscurrently expect the company to report EPS of $5.38 for 2021 and grow at a fast pace to reach EPS of $10.33 for 2024. As I mentioned in my earlier article, I believe that, given comparison with other major automobile companies, the company is fairly valued at around 75x forward earnings.</p>\n<p>I do, however, believe that some of the current competition expectations are overblown for the near term, as I've been mentioning throughout the entire article. Therefore, I do believe that Tesla will outperform current expectations at least through 2023. This means that a 75x forward earnings multiple is the ground base for appropriate valuation, I believe.</p>\n<p>This presents the following fair value, with the implied increase potential:</p>\n<p><img src=\"https://static.tigerbbs.com/052968e079d7fe8419e4790de451c9fd\" tg-width=\"620\" tg-height=\"201\" width=\"100%\" height=\"auto\">As you can see, this means that Tesla is almost 40% overvalued relative to earnings expectations, even if they overcome them by as much as 20%. However, given that these expectations are likely to be beaten, I don't believe that shorting the company is a good idea, but one thing that is worth looking out for is a general market correction.</p>\n<p>The Biggest Risk Of Owning Tesla</p>\n<p>The biggest risk with owning Tesla right now is that, in a general market correction, which can happen at any moment as the post-pandemic trade is winding down, companies with lofty expectations tend to fall the most as fair value is sought beyond what their potential is way down the line.</p>\n<p>I don't believe that shorting Tesla is the right approach, even though my disclosures down below and in previous article state that I am, given general market exposure. I am short simply because I don't believe that much upwards potential is there, whilst downward potential in a market correction is vast. So, given that I am mostly long, this short is a general portfolio hedge while I reduce positions in case of a correction.</p>\n<p>In Conclusion</p>\n<p>Tesla has several positive catalysts which should keep them on top of the EV industry growth roster for the next 24 to 36 months, while other companies struggle to make even a single penny on their new vehicles. These are set, I believe, to allow them to beat earnings expectations for that time period.</p>\n<p>Even so, their long-term competitive pressures remain high and as I stated in my previous article - their long-term growth prospects will continue to dim as time moves on.</p>\n<p>Even with these positive near-term advantages, I still believe that the company is overvalued by as much as 40%, and although I do not favor shorting the company for this overvaluation, I remain slightly bearish on their long-term prospects and neutral to slightly bullish on their near-term one.</p>","source":"seekingalpha","collect":0,"html":"<!DOCTYPE html>\n<html>\n<head>\n<meta http-equiv=\"Content-Type\" content=\"text/html; These advantages mean that the company will remain superior in the near term when it comes to profitability and diversity within the EV industry and can best utilize the rapid growth rate the entire industry is expecting.\nThe Long-Term Headwinds Haven't Changed\nAs I've been highlighting for several months now,Tesla's long-term prospects have dimmedsince other automobile companies like Ford and General Motors (GM) in the United States, NIO (NIO) and others in the Asia-Pacific region and other European and South Korean automobile manufacturers moved up their electrification process timelines. The main reason for this is that these companies have very solid brand recognition, and individuals who have owned these models for years or decades have the option to opt for an electric version of those; they choose those over trying out a new untested model a majority of the time.\nWith companies like Ford introducing the all-electric F-150 and others, it's unclear how Tesla can maintain this high growth rate beyond 2024 as these models are expected to hit the streets and begin capturing back market share away from Tesla and other current models. Other factors like Tesla opening up their charging station network to all EV models, as well as a massive capital injection into EV charging stations in the most recent infrastructure spending bill in the United States, will surely help Tesla's income when it charges for the use, but it also helps other companies overcome the main hurdle of widespread adoption - clearing a pathway for more and more EV models to emerge.\nThe Short-Term Tailwinds Are Emerging\nTesla has several near-term tailwinds which will keep way ahead of any competition for the next 12 to 24 months. These mostly all boil down to profitability but also focus on various business model advantages.\n1. A positive profit margin: While other companies are just now beginning to invest in transforming their manufacturing facilities from fossil fuel intake engines to electric vehicle production, Tesla has done this and way more efficiently. Since they've built these from scratch, they've mostly automated the process and thus enjoy a much higher profit margin. Other companies won't see a profit per vehicle for years to come.\n2. Surging battery manufacturing: Although other companies have a mixed position on whether to manufacture their own batteries or set up joint ventures with existing companies, Tesla has been churning out batteries for years and have, as similar with the vehicle manufacturing process, nearly fully automated the process to maximize profits per unit.\n3. International manufacturing: Other companies, thus far, have focused on restructuring and transforming current assembly plants in the United States and will likely take several more years before they do so for other international facilities, which means they will need to spend a fortune shipping these new vehicles around the world to the EMEA and the Asia-Pacific. Tesla, on the other hand, has manufacturing facilities in the United States and in China and is set to open their plant in Germany as well as being in final development stages of an India plant, which will allow them to access a much larger market.\n4. Charging stations advantage: Although the new infrastructure bill in the United States, as well as massive investments in countries like Japan and China, are certain to put in hundreds of thousands of new EV charging stations across the globe, this will take time. So far, only Tesla has a real robust charging network across the world. A recent development, which does have negative elements to it as mentioned earlier, has a positive near term one - they will be raking in net profits from allowing other electric vehicles to charge on their network. This means that they'll likely be profiting from each vehicle their competitors churn out, at least until the scaling up of non-Tesla charging stations takes place.\n5. \"Other Business\" growth rate: While other automobile companies are still spending hand over fist on their other models and products, Tesla enjoys being only in high-growth industries like SolarCity's solar panels and battery sales. As I'll expand on in the next segment, they also don't have near-term or long-term financial obligations from these \"other business\" segments as establishment automobile companies have.\nBalance Sheet Advantages\nAlthough some elements of their balance sheet advantage are set to help them in the long run as well, they're mostly advantages for the short term since once these other companies begin making a profit from their EV sales - a lot of this will be reversed.\nTesla's main advantage, as mentioned earlier, is that they're actually raking in cash from each car they sell, allowing them to use that cash to continue and set up more manufacturing facilities and invest in battery technology, solar technology and production increases. This is contrary to other automobile companies which have high financial obligations to their other business segments like pensions and leases. This will further aid the company's overall profit margin, while they don't struggle with such obligations.\nThese other companies will need to use profits and cash from their existing legacy business segments to pay for their losses on each vehicle they produce, hurting their overall valuation moving forward.\nAlthough Tesla has $6.9 billion inlong-term debt, a factor which kept many investors on the sidelines as debt racked up, they currently hold just under $16.3 billion in cash and equivalents, making their net debt position negative. They've been using the cash to pay down their debt as well,reducing their interest expense burdenfrom almost $800 million in 2020 to just over $500 million in 2021. Tesla paid back $15 billion in debt in 2021 for a net debt reduction of $6 billion. There's very little doubt that other automobile companies will be forced to take on more debt to finance increased production and in this raising rate environment, that can snowball.\nTesla is set to seecash flowof around $10 billion annually whereas a company like Ford has been fluctuating between a net positive and negative cash flow status for the past few years, and that's not expected to change through 2025 as they continue to increase investments in the electrification of their vehicles.\nWhat About Current Valuation\nAnalystscurrently expect the company to report EPS of $5.38 for 2021 and grow at a fast pace to reach EPS of $10.33 for 2024. As I mentioned in my earlier article, I believe that, given comparison with other major automobile companies, the company is fairly valued at around 75x forward earnings.\nI do, however, believe that some of the current competition expectations are overblown for the near term, as I've been mentioning throughout the entire article. Therefore, I do believe that Tesla will outperform current expectations at least through 2023. This means that a 75x forward earnings multiple is the ground base for appropriate valuation, I believe.\nThis presents the following fair value, with the implied increase potential:\nAs you can see, this means that Tesla is almost 40% overvalued relative to earnings expectations, even if they overcome them by as much as 20%. However, given that these expectations are likely to be beaten, I don't believe that shorting the company is a good idea, but one thing that is worth looking out for is a general market correction.\nThe Biggest Risk Of Owning Tesla\nThe biggest risk with owning Tesla right now is that, in a general market correction, which can happen at any moment as the post-pandemic trade is winding down, companies with lofty expectations tend to fall the most as fair value is sought beyond what their potential is way down the line.\nI don't believe that shorting Tesla is the right approach, even though my disclosures down below and in previous article state that I am, given general market exposure. I am short simply because I don't believe that much upwards potential is there, whilst downward potential in a market correction is vast. So, given that I am mostly long, this short is a general portfolio hedge while I reduce positions in case of a correction.\nIn Conclusion\nTesla has several positive catalysts which should keep them on top of the EV industry growth roster for the next 24 to 36 months, while other companies struggle to make even a single penny on their new vehicles. Sales slowed for the trio of Chinese EV startups vs. March's pace, as<b>Tesla</b>(TSLA) ramps up competition.</p><p>Nio stock reversed slightly Monday, while Xpeng and Li Auto also fell.</p><p>Year over year, Nio's April sales jumped 125% to 5,147 electric vehicles. That included 1,523 seven-seater ES8 SUVs, 3,163 five-seater ES6 SUVs, and 2,416 EC6 electric crossovers.</p><p>Sales growth slowed from the 373% pace that Nio saw in March.</p><p>But Nio's April EV sales defied the chip shortage that forced the emerging Tesla of China to temporarily suspend factory production for five days starting March 29.</p><p>Year over year, Xpeng Motors saw April sales surge 285% to 5,147 electric vehicles. That included 2,995 P7 sedans and 2,152 G3 compact SUVs.</p><p>However, growth slowed from March's 384% pace.</p><p>Year over year, Li Auto's April sales increased 111% to 5,539 hybrid-electric SUVs. Sales growth slowed from March's 239% pace.</p><p>Li Auto reached a milestone 500,000th delivery faster than any of its peers, the Chinese EV startup said in a statement.</p><p>Month to month, Nio sales fell 2.1%. Nio last week indicated that Q2 deliveries would roughly flat vs. Q1 amid chip shortages. Xpeng sales rose 1% vs. March. According to police, <a href=\"https://laohu8.com/S/AONE\">one</a> had been sitting in the front passenger seat, the other in the back of the car.</p>\n<p>While investigators have not said whether they believe Tesla’s Autopilot technology was steering, the men’s wives told local reporters the pair went out for a late-night drive Saturday drive after talking about the system. </p>\n<p>Tesla Chief Executive Elon Musk pushed back on speculation but also asserted no conclusion, tweeting Monday that \"Data logs recovered so far show Autopilot was not enabled.\" The company has resisted sharing data logs for independent review without a legal order. </p>\n<p>Following Musk's tweet, a county police official told Reuters that the department would serve a warrant for the data.</p>\n<p>Autopilot technically requires the human driver to pay full attention, but it’s easy to cheat the system, and the internet is rife videos of pranksters sitting in the back while a Tesla cruises down the highway with the driver seat empty.</p>\n<p>It's a state of affairs that leaves many auto safety experts and driverless technology advocates wondering just what it will take before regulators step in and put an end to the word games and rule-skirting that have allowed it to continue. Could the crash in Houston provide that impetus?</p>\n<p>“I suspect there will be big fallout from this,” said Alain Kornhauser, head of the driverless car program at Princeton University. </p>\n<p>Tesla’s Autopilot system has been involved in several fatal crashes since 2016, when a Florida man was decapitated as a Tesla on Autopilot drove him under the trailer of a semi truck. Less lethally, Teslas have slammed into the back of fire trucks, police cars and other vehicles stopped on highway lanes.</p>\n<p>Yet little action has been taken by federal safety officials and none at all by the California Department of Motor Vehicles, which has allowed Tesla to test its autonomous technology on public roads without requiring that it conform to the rules that dozens of other autonomous tech companies are following.</p>\n<p>The National Highway Traffic Safety Administration said Monday that it had dispatched a “Special Crash Investigation team” to Texas. The agency, an arm of the U.S. Department of Transportation, said it “will take appropriate steps when we have more information.”</p>\n<p>The agency declined to speak with The Times about what those steps might be.</p>\n<p>Since 2016, NHTSA has launched investigations into at least 23 crashes involving Autopilot; but if they resulted in any conclusion or action, NHTSA hasn’t told the public about it.</p>\n<p>Jason Levine, executive director of the Center for Auto Safety, thinks it’s about time that changes. </p>\n<p>“There doesn’t seem to be much activity coming out of our federal safety administration with respect to what is pretty evidently becoming a public danger,” he said. “You’ve got the market getting ahead of regulators, which isn’t uncommon, but this all didn’t start yesterday.”</p>\n<p>Tesla sells an enhanced version of Autopilot called Full Self-Driving Capability for $10,000, although there is no car sold anywhere in the world today that is capable of full self-driving.</p>\n<figure>\n<img height=\"486\" src=\"https://s.yimg.com/uu/api/res/1.2/kMQfHzCSxI.ut78WsNYt1A--/cT03NTthcHBpZD15dmlkZW9mZWVkczs-/https://media.zenfs.com/en/la_times_articles_853/fc6b2a32868e479461712ea16283f11e\" width=\"1412\"/>\n<figcaption>\n A search for \"full-self driving definition\" on Google turns up this snippet. \n </figcaption>\n</figure>\n<p>Although Tesla technology might well be safe when used as directed, Tesla’s marketing can lead people to believe the car is capable of autonomous driving. NHTSA, Levine points out, has rules against “predictable abuse” in automotive technology. </p>\n<p>“It is predictable when you call something Autopilot it means autopilot, and when you call something Full Self-Driving it means full self-driving,” he said. </p>\n<p>Incidents like the fatal Texas crash “are foreseeable incidents,” Levine said, “no matter how many disclaimers Tesla lawyers decide to insert in fine print.”</p>\n<p>Musk disbanded the company’s media relations department in 2019. Emails to the company were not returned.</p>\n<p>The California DMV is in a position to clarify matters but thus far has not. In previously undisclosed emails to the DMV in recent months, made public by the legal document transparency organization Plainsite, Tesla told the DMV that its system is not autonomous but a so-called Level 2 driver assist system.</p>\n<p>The DMVs own regulations bar companies from advertising sale or lease of a vehicle as autonomous if it “will likely induce a prudent person to believe a vehicle is autonomous.”</p>\n<p>In public presentations and slideshows, DMV Deputy Director Bernard Soriano described Level 4 automation, which requires no human driver, this way: “Full self-driving.”</p>\n<p>The DMV did not respond to a request for comment.</p>\n<p>Adding to the confusion, Musk himself has appeared on \"60 Minutes\" and Bloomberg TV behind the wheel of a Tesla with his hands in the air. He’s been talking about Tesla fully autonomous technology as if it’s imminent since 2016. That year, Tesla posted a video showing <a href=\"https://laohu8.com/S/AONE.U\">one</a> of its cars running in autonomous mode through Palo Alto. “The person in the driver’s seat is only there for legal reasons,\" the video said.</p>\n<p>The same year he announced a coast-to-coast test drive of an autonomous Tesla by the end of 2017, which as of April 2021 has not happened. He told a Shanghai conference in 2020 that the “basic functionality” for fully autonomous driving would be complete that year. It wasn’t. He said the company would have a million driverless robotaxis on the road by the end of 2020, which would cause Tesla cars to appreciate in value. So far there are none.</p>\n<p>The misleading promises and the confusing nomenclature are beginning to rile other players in the driverless car industry. Several industry executives have told The Times that they fear that Musk’s behavior could disturb the public and cause policymakers to enact restrictive laws and regulations that could unnecessarily delay the introduction of driverless cars.</p>\n<p>Now, some are beginning to speak out publicly.</p>\n<p>“We’ve had multiple years of claims that ‘by the end of the year it’s going to be magically self-driving by itself without a human in the car,’” Ford’s autonomous vehicles head, John Rich, said at a recent Princeton University conference. “It is not helpful, OK? It is confusing the public. Frankly even the investor community is very, very confused as to what paths are plausible and what the capabilities of the different systems are.”</p>\n<p>Musk has long cultivated a maverick approach to robot-car technologies. Other car and tech companies combine radar, lidar and visual sensors in their systems to identify and analyze a robot-car’s surroundings. Musk believes lidar is an unnecessary expense and recently announced Tesla would soon stop using radar, too, relying solely on visual sensors for the main driving task.</p>\n<p>And while other companies with advanced driver-assist systems similar to Autopilot use infrared cameras to make sure a human is in the driver’s seat and paying attention to the road ahead, Musk specifically rejected that technology in favor of a steering wheel sensor that can be easily defeated by hanging a weight off the wheel or jamming an object into it.</p>\n<p>General Motors’ SuperCruise system, for example, allows hands-free driving and automated lane changing on interstates and other limited-access highways, but monitors the driver to ensure they’re paying attention to the driving task. If not, warning lights and sounds are deployed. If the driver remains inattentive, the car will exit traffic lanes and stop itself.</p>\n<p>Ford recently announced a similar product, BlueCruise, expected to become available later this year on Mustang Mach E electric cars and Ford F-150 pickups. According to police, one had been sitting in the front passenger seat, the other in the back of the car.\nWhile investigators have not said whether they believe Tesla’s Autopilot technology was steering, the men’s wives told local reporters the pair went out for a late-night drive Saturday drive after talking about the system. \nTesla Chief Executive Elon Musk pushed back on speculation but also asserted no conclusion, tweeting Monday that \"Data logs recovered so far show Autopilot was not enabled.\" The company has resisted sharing data logs for independent review without a legal order. \nFollowing Musk's tweet, a county police official told Reuters that the department would serve a warrant for the data.\nAutopilot technically requires the human driver to pay full attention, but it’s easy to cheat the system, and the internet is rife videos of pranksters sitting in the back while a Tesla cruises down the highway with the driver seat empty.\nIt's a state of affairs that leaves many auto safety experts and driverless technology advocates wondering just what it will take before regulators step in and put an end to the word games and rule-skirting that have allowed it to continue. Could the crash in Houston provide that impetus?\n“I suspect there will be big fallout from this,” said Alain Kornhauser, head of the driverless car program at Princeton University. \nTesla’s Autopilot system has been involved in several fatal crashes since 2016, when a Florida man was decapitated as a Tesla on Autopilot drove him under the trailer of a semi truck. Less lethally, Teslas have slammed into the back of fire trucks, police cars and other vehicles stopped on highway lanes.\nYet little action has been taken by federal safety officials and none at all by the California Department of Motor Vehicles, which has allowed Tesla to test its autonomous technology on public roads without requiring that it conform to the rules that dozens of other autonomous tech companies are following.\nThe National Highway Traffic Safety Administration said Monday that it had dispatched a “Special Crash Investigation team” to Texas. The agency, an arm of the U.S. Department of Transportation, said it “will take appropriate steps when we have more information.”\nThe agency declined to speak with The Times about what those steps might be.\nSince 2016, NHTSA has launched investigations into at least 23 crashes involving Autopilot; but if they resulted in any conclusion or action, NHTSA hasn’t told the public about it.\nJason Levine, executive director of the Center for Auto Safety, thinks it’s about time that changes. \n“There doesn’t seem to be much activity coming out of our federal safety administration with respect to what is pretty evidently becoming a public danger,” he said. “You’ve got the market getting ahead of regulators, which isn’t uncommon, but this all didn’t start yesterday.”\nTesla sells an enhanced version of Autopilot called Full Self-Driving Capability for $10,000, although there is no car sold anywhere in the world today that is capable of full self-driving.\n\n\n\n A search for \"full-self driving definition\" on Google turns up this snippet. \n \n\nAlthough Tesla technology might well be safe when used as directed, Tesla’s marketing can lead people to believe the car is capable of autonomous driving. NHTSA, Levine points out, has rules against “predictable abuse” in automotive technology. \n“It is predictable when you call something Autopilot it means autopilot, and when you call something Full Self-Driving it means full self-driving,” he said. \nIncidents like the fatal Texas crash “are foreseeable incidents,” Levine said, “no matter how many disclaimers Tesla lawyers decide to insert in fine print.”\nMusk disbanded the company’s media relations department in 2019. Emails to the company were not returned.\nThe California DMV is in a position to clarify matters but thus far has not. In previously undisclosed emails to the DMV in recent months, made public by the legal document transparency organization Plainsite, Tesla told the DMV that its system is not autonomous but a so-called Level 2 driver assist system.\nThe DMVs own regulations bar companies from advertising sale or lease of a vehicle as autonomous if it “will likely induce a prudent person to believe a vehicle is autonomous.”\nIn public presentations and slideshows, DMV Deputy Director Bernard Soriano described Level 4 automation, which requires no human driver, this way: “Full self-driving.”\nThe DMV did not respond to a request for comment.\nAdding to the confusion, Musk himself has appeared on \"60 Minutes\" and Bloomberg TV behind the wheel of a Tesla with his hands in the air. He’s been talking about Tesla fully autonomous technology as if it’s imminent since 2016. That year, Tesla posted a video showing one of its cars running in autonomous mode through Palo Alto. “The person in the driver’s seat is only there for legal reasons,\" the video said.\nThe same year he announced a coast-to-coast test drive of an autonomous Tesla by the end of 2017, which as of April 2021 has not happened. He told a Shanghai conference in 2020 that the “basic functionality” for fully autonomous driving would be complete that year. It wasn’t. He said the company would have a million driverless robotaxis on the road by the end of 2020, which would cause Tesla cars to appreciate in value. So far there are none.\nThe misleading promises and the confusing nomenclature are beginning to rile other players in the driverless car industry. Several industry executives have told The Times that they fear that Musk’s behavior could disturb the public and cause policymakers to enact restrictive laws and regulations that could unnecessarily delay the introduction of driverless cars.\nNow, some are beginning to speak out publicly.\n“We’ve had multiple years of claims that ‘by the end of the year it’s going to be magically self-driving by itself without a human in the car,’” Ford’s autonomous vehicles head, John Rich, said at a recent Princeton University conference. “It is not helpful, OK? It is confusing the public. Frankly even the investor community is very, very confused as to what paths are plausible and what the capabilities of the different systems are.”\nMusk has long cultivated a maverick approach to robot-car technologies. Other car and tech companies combine radar, lidar and visual sensors in their systems to identify and analyze a robot-car’s surroundings. Musk believes lidar is an unnecessary expense and recently announced Tesla would soon stop using radar, too, relying solely on visual sensors for the main driving task.\nAnd while other companies with advanced driver-assist systems similar to Autopilot use infrared cameras to make sure a human is in the driver’s seat and paying attention to the road ahead, Musk specifically rejected that technology in favor of a steering wheel sensor that can be easily defeated by hanging a weight off the wheel or jamming an object into it.\nGeneral Motors’ SuperCruise system, for example, allows hands-free driving and automated lane changing on interstates and other limited-access highways, but monitors the driver to ensure they’re paying attention to the driving task. If not, warning lights and sounds are deployed. If the driver remains inattentive, the car will exit traffic lanes and stop itself.\nFord recently announced a similar product, BlueCruise, expected to become available later this year on Mustang Mach E electric cars and Ford F-150 pickups. This is what they want you to know now right now:</p><p>Yes, You’re Smart. Don’t Let That Hurt You</p><p>With more time and cash than usual, many home-bound workers have started paying closer attention to markets. Maybe $2 Billion</p><p>This collective knowledge has probably already increased shares to a peak, he said. “Eventually once they squeeze enough of these short sellers out, the opportunity for people to pile in and keep pushing up the share price is going to evaporate.”</p><p>You’re Not a Hedge Fund</p><p>One of the striking developments about this week’s Reddit wave was that GameStop boosters on social media effectively forced Melvin Capital, a $12.5 billion hedge fund, toback down from its short position on the stock— or its bet that shares of the video-game retailer will drop.</p><p>This might make you feel empowered to join in on the action. But advisers caution that one win for Reddit users is unlikely to translate into continuous, long-term gains for you.</p><p>“On the institutional side they’re all unified in their position and their rationale behind what they're doing,” said Dana Menard, the founder and CEO of Twin Cities Wealth Strategies Inc. Yet on a decentralized, digital community like Reddit, users will undoubtedly have myriad motives for boosting a stock, and your financial wellbeing is likely not one of them.</p><p>Large financial firms also have access to information individual investors just can’t get. Because of this, Menard says investors should be wary of stock boosters promoting their own research.</p><p>“While they’ve read about a couple indicators here or there, they certainly are not privy to the information that institutional investors have,” said Menard. “Unless these people are actually going into GameStop to interview the CEO and getting access to their books like institutional investors do, then it’s completely hearsay.”</p><p>You’re Probably Not Running for Governor of California</p><p>Yes, wealthy investors have recently revealed their stakes in GameStop, pumping the share price even more. Ryan Cohen, co-founder of Chewy Inc., is one of them. Chamath Palihapitiya, a venture capitalist and former Facebook Inc. executive, is another.</p><p>But they’re both billionaires. On Monday, Palihapitiya bothannounced he was running for governor of Californiaand invested in twoSPAC deals. Someone making those kinds of bets can likely afford to lose money on an investment.</p><p>Chances are your balance sheet looks a bit different. Menard encourages retail investors to think twice about any money they put in speculative shares, and only allocate what they can afford to lose completely.</p><p>That said, he recognizes that some investors may want to get in on the frenzy. And that’s fine, as long as it’s just a small portion of a portfolio.</p><p>“I call it their play money. Sales slowed for the trio of Chinese EV startups vs. March's pace, as<b>Tesla</b>(TSLA) ramps up competition.</p><p>Nio stock reversed slightly Monday, while Xpeng and Li Auto also fell.</p><p>Year over year, Nio's April sales jumped 125% to 5,147 electric vehicles. That included 1,523 seven-seater ES8 SUVs, 3,163 five-seater ES6 SUVs, and 2,416 EC6 electric crossovers.</p><p>Sales growth slowed from the 373% pace that Nio saw in March.</p><p>But Nio's April EV sales defied the chip shortage that forced the emerging Tesla of China to temporarily suspend factory production for five days starting March 29.</p><p>Year over year, Xpeng Motors saw April sales surge 285% to 5,147 electric vehicles. That included 2,995 P7 sedans and 2,152 G3 compact SUVs.</p><p>However, growth slowed from March's 384% pace.</p><p>Year over year, Li Auto's April sales increased 111% to 5,539 hybrid-electric SUVs. Sales growth slowed from March's 239% pace.</p><p>Li Auto reached a milestone 500,000th delivery faster than any of its peers, the Chinese EV startup said in a statement.</p><p>Month to month, Nio sales fell 2.1%. These advantages mean that the company will remain superior in the near term when it comes to profitability and diversity within the EV industry and can best utilize the rapid growth rate the entire industry is expecting.</p>\n<p>The Long-Term Headwinds Haven't Changed</p>\n<p>As I've been highlighting for several months now,Tesla's long-term prospects have dimmedsince other automobile companies like Ford and General Motors (GM) in the United States, NIO (NIO) and others in the Asia-Pacific region and other European and South Korean automobile manufacturers moved up their electrification process timelines. The main reason for this is that these companies have very solid brand recognition, and individuals who have owned these models for years or decades have the option to opt for an electric version of those; they choose those over trying out a new untested model a majority of the time.</p>\n<p>With companies like Ford introducing the all-electric F-150 and others, it's unclear how Tesla can maintain this high growth rate beyond 2024 as these models are expected to hit the streets and begin capturing back market share away from Tesla and other current models. Other factors like Tesla opening up their charging station network to all EV models, as well as a massive capital injection into EV charging stations in the most recent infrastructure spending bill in the United States, will surely help Tesla's income when it charges for the use, but it also helps other companies overcome the main hurdle of widespread adoption - clearing a pathway for more and more EV models to emerge.</p>\n<p>The Short-Term Tailwinds Are Emerging</p>\n<p>Tesla has several near-term tailwinds which will keep way ahead of any competition for the next 12 to 24 months. These mostly all boil down to profitability but also focus on various business model advantages.</p>\n<p>1. A positive profit margin: While other companies are just now beginning to invest in transforming their manufacturing facilities from fossil fuel intake engines to electric vehicle production, Tesla has done this and way more efficiently. Since they've built these from scratch, they've mostly automated the process and thus enjoy a much higher profit margin. Other companies won't see a profit per vehicle for years to come.</p>\n<p>2. Surging battery manufacturing: Although other companies have a mixed position on whether to manufacture their own batteries or set up joint ventures with existing companies, Tesla has been churning out batteries for years and have, as similar with the vehicle manufacturing process, nearly fully automated the process to maximize profits per unit.</p>\n<p>3. International manufacturing: Other companies, thus far, have focused on restructuring and transforming current assembly plants in the United States and will likely take several more years before they do so for other international facilities, which means they will need to spend a fortune shipping these new vehicles around the world to the EMEA and the Asia-Pacific. Tesla, on the other hand, has manufacturing facilities in the United States and in China and is set to open their plant in Germany as well as being in final development stages of an India plant, which will allow them to access a much larger market.</p>\n<p>4. Charging stations advantage: Although the new infrastructure bill in the United States, as well as massive investments in countries like Japan and China, are certain to put in hundreds of thousands of new EV charging stations across the globe, this will take time. So far, only Tesla has a real robust charging network across the world. A recent development, which does have negative elements to it as mentioned earlier, has a positive near term one - they will be raking in net profits from allowing other electric vehicles to charge on their network. This means that they'll likely be profiting from each vehicle their competitors churn out, at least until the scaling up of non-Tesla charging stations takes place.</p>\n<p>5. \"Other Business\" growth rate: While other automobile companies are still spending hand over fist on their other models and products, Tesla enjoys being only in high-growth industries like SolarCity's solar panels and battery sales. As I'll expand on in the next segment, they also don't have near-term or long-term financial obligations from these \"other business\" segments as establishment automobile companies have.</p>\n<p>Balance Sheet Advantages</p>\n<p>Although some elements of their balance sheet advantage are set to help them in the long run as well, they're mostly advantages for the short term since once these other companies begin making a profit from their EV sales - a lot of this will be reversed.</p>\n<p>Tesla's main advantage, as mentioned earlier, is that they're actually raking in cash from each car they sell, allowing them to use that cash to continue and set up more manufacturing facilities and invest in battery technology, solar technology and production increases. This is contrary to other automobile companies which have high financial obligations to their other business segments like pensions and leases. This will further aid the company's overall profit margin, while they don't struggle with such obligations.</p>\n<p>These other companies will need to use profits and cash from their existing legacy business segments to pay for their losses on each vehicle they produce, hurting their overall valuation moving forward.</p>\n<p>Although Tesla has $6.9 billion inlong-term debt, a factor which kept many investors on the sidelines as debt racked up, they currently hold just under $16.3 billion in cash and equivalents, making their net debt position negative. They've been using the cash to pay down their debt as well,reducing their interest expense burdenfrom almost $800 million in 2020 to just over $500 million in 2021. Tesla paid back $15 billion in debt in 2021 for a net debt reduction of $6 billion. There's very little doubt that other automobile companies will be forced to take on more debt to finance increased production and in this raising rate environment, that can snowball.</p>\n<p>Tesla is set to seecash flowof around $10 billion annually whereas a company like Ford has been fluctuating between a net positive and negative cash flow status for the past few years, and that's not expected to change through 2025 as they continue to increase investments in the electrification of their vehicles.</p>\n<p>What About Current Valuation</p>\n<p>Analystscurrently expect the company to report EPS of $5.38 for 2021 and grow at a fast pace to reach EPS of $10.33 for 2024. As I mentioned in my earlier article, I believe that, given comparison with other major automobile companies, the company is fairly valued at around 75x forward earnings.</p>\n<p>I do, however, believe that some of the current competition expectations are overblown for the near term, as I've been mentioning throughout the entire article. Therefore, I do believe that Tesla will outperform current expectations at least through 2023. These advantages mean that the company will remain superior in the near term when it comes to profitability and diversity within the EV industry and can best utilize the rapid growth rate the entire industry is expecting.\nThe Long-Term Headwinds Haven't Changed\nAs I've been highlighting for several months now,Tesla's long-term prospects have dimmedsince other automobile companies like Ford and General Motors (GM) in the United States, NIO (NIO) and others in the Asia-Pacific region and other European and South Korean automobile manufacturers moved up their electrification process timelines. The main reason for this is that these companies have very solid brand recognition, and individuals who have owned these models for years or decades have the option to opt for an electric version of those; they choose those over trying out a new untested model a majority of the time.\nWith companies like Ford introducing the all-electric F-150 and others, it's unclear how Tesla can maintain this high growth rate beyond 2024 as these models are expected to hit the streets and begin capturing back market share away from Tesla and other current models. Other factors like Tesla opening up their charging station network to all EV models, as well as a massive capital injection into EV charging stations in the most recent infrastructure spending bill in the United States, will surely help Tesla's income when it charges for the use, but it also helps other companies overcome the main hurdle of widespread adoption - clearing a pathway for more and more EV models to emerge.\nThe Short-Term Tailwinds Are Emerging\nTesla has several near-term tailwinds which will keep way ahead of any competition for the next 12 to 24 months. These mostly all boil down to profitability but also focus on various business model advantages.\n1. A positive profit margin: While other companies are just now beginning to invest in transforming their manufacturing facilities from fossil fuel intake engines to electric vehicle production, Tesla has done this and way more efficiently. Since they've built these from scratch, they've mostly automated the process and thus enjoy a much higher profit margin. Other companies won't see a profit per vehicle for years to come.\n2. Surging battery manufacturing: Although other companies have a mixed position on whether to manufacture their own batteries or set up joint ventures with existing companies, Tesla has been churning out batteries for years and have, as similar with the vehicle manufacturing process, nearly fully automated the process to maximize profits per unit.\n3. International manufacturing: Other companies, thus far, have focused on restructuring and transforming current assembly plants in the United States and will likely take several more years before they do so for other international facilities, which means they will need to spend a fortune shipping these new vehicles around the world to the EMEA and the Asia-Pacific. Tesla, on the other hand, has manufacturing facilities in the United States and in China and is set to open their plant in Germany as well as being in final development stages of an India plant, which will allow them to access a much larger market.\n4. Charging stations advantage: Although the new infrastructure bill in the United States, as well as massive investments in countries like Japan and China, are certain to put in hundreds of thousands of new EV charging stations across the globe, this will take time. So far, only Tesla has a real robust charging network across the world. A recent development, which does have negative elements to it as mentioned earlier, has a positive near term one - they will be raking in net profits from allowing other electric vehicles to charge on their network. This means that they'll likely be profiting from each vehicle their competitors churn out, at least until the scaling up of non-Tesla charging stations takes place.\n5. \"Other Business\" growth rate: While other automobile companies are still spending hand over fist on their other models and products, Tesla enjoys being only in high-growth industries like SolarCity's solar panels and battery sales. As I'll expand on in the next segment, they also don't have near-term or long-term financial obligations from these \"other business\" segments as establishment automobile companies have.\nBalance Sheet Advantages\nAlthough some elements of their balance sheet advantage are set to help them in the long run as well, they're mostly advantages for the short term since once these other companies begin making a profit from their EV sales - a lot of this will be reversed.\nTesla's main advantage, as mentioned earlier, is that they're actually raking in cash from each car they sell, allowing them to use that cash to continue and set up more manufacturing facilities and invest in battery technology, solar technology and production increases. This is contrary to other automobile companies which have high financial obligations to their other business segments like pensions and leases. This will further aid the company's overall profit margin, while they don't struggle with such obligations.\nThese other companies will need to use profits and cash from their existing legacy business segments to pay for their losses on each vehicle they produce, hurting their overall valuation moving forward.\nAlthough Tesla has $6.9 billion inlong-term debt, a factor which kept many investors on the sidelines as debt racked up, they currently hold just under $16.3 billion in cash and equivalents, making their net debt position negative. They've been using the cash to pay down their debt as well,reducing their interest expense burdenfrom almost $800 million in 2020 to just over $500 million in 2021. Tesla paid back $15 billion in debt in 2021 for a net debt reduction of $6 billion. There's very little doubt that other automobile companies will be forced to take on more debt to finance increased production and in this raising rate environment, that can snowball.\nTesla is set to seecash flowof around $10 billion annually whereas a company like Ford has been fluctuating between a net positive and negative cash flow status for the past few years, and that's not expected to change through 2025 as they continue to increase investments in the electrification of their vehicles.\nWhat About Current Valuation\nAnalystscurrently expect the company to report EPS of $5.38 for 2021 and grow at a fast pace to reach EPS of $10.33 for 2024. According to police, <a href=\"https://laohu8.com/S/AONE\">one</a> had been sitting in the front passenger seat, the other in the back of the car.</p>\n<p>While investigators have not said whether they believe Tesla’s Autopilot technology was steering, the men’s wives told local reporters the pair went out for a late-night drive Saturday drive after talking about the system. </p>\n<p>Tesla Chief Executive Elon Musk pushed back on speculation but also asserted no conclusion, tweeting Monday that \"Data logs recovered so far show Autopilot was not enabled.\" The company has resisted sharing data logs for independent review without a legal order. </p>\n<p>Following Musk's tweet, a county police official told Reuters that the department would serve a warrant for the data.</p>\n<p>Autopilot technically requires the human driver to pay full attention, but it’s easy to cheat the system, and the internet is rife videos of pranksters sitting in the back while a Tesla cruises down the highway with the driver seat empty.</p>\n<p>It's a state of affairs that leaves many auto safety experts and driverless technology advocates wondering just what it will take before regulators step in and put an end to the word games and rule-skirting that have allowed it to continue. Could the crash in Houston provide that impetus?</p>\n<p>“I suspect there will be big fallout from this,” said Alain Kornhauser, head of the driverless car program at Princeton University. </p>\n<p>Tesla’s Autopilot system has been involved in several fatal crashes since 2016, when a Florida man was decapitated as a Tesla on Autopilot drove him under the trailer of a semi truck. Less lethally, Teslas have slammed into the back of fire trucks, police cars and other vehicles stopped on highway lanes.</p>\n<p>Yet little action has been taken by federal safety officials and none at all by the California Department of Motor Vehicles, which has allowed Tesla to test its autonomous technology on public roads without requiring that it conform to the rules that dozens of other autonomous tech companies are following.</p>\n<p>The National Highway Traffic Safety Administration said Monday that it had dispatched a “Special Crash Investigation team” to Texas. The agency, an arm of the U.S. Department of Transportation, said it “will take appropriate steps when we have more information.”</p>\n<p>The agency declined to speak with The Times about what those steps might be.</p>\n<p>Since 2016, NHTSA has launched investigations into at least 23 crashes involving Autopilot; but if they resulted in any conclusion or action, NHTSA hasn’t told the public about it.</p>\n<p>Jason Levine, executive director of the Center for Auto Safety, thinks it’s about time that changes. </p>\n<p>“There doesn’t seem to be much activity coming out of our federal safety administration with respect to what is pretty evidently becoming a public danger,” he said. “You’ve got the market getting ahead of regulators, which isn’t uncommon, but this all didn’t start yesterday.”</p>\n<p>Tesla sells an enhanced version of Autopilot called Full Self-Driving Capability for $10,000, although there is no car sold anywhere in the world today that is capable of full self-driving.</p>\n<figure>\n<img height=\"486\" src=\"https://s.yimg.com/uu/api/res/1.2/kMQfHzCSxI.ut78WsNYt1A--/cT03NTthcHBpZD15dmlkZW9mZWVkczs-/https://media.zenfs.com/en/la_times_articles_853/fc6b2a32868e479461712ea16283f11e\" width=\"1412\"/>\n<figcaption>\n A search for \"full-self driving definition\" on Google turns up this snippet. \n </figcaption>\n</figure>\n<p>Although Tesla technology might well be safe when used as directed, Tesla’s marketing can lead people to believe the car is capable of autonomous driving. NHTSA, Levine points out, has rules against “predictable abuse” in automotive technology. </p>\n<p>“It is predictable when you call something Autopilot it means autopilot, and when you call something Full Self-Driving it means full self-driving,” he said. </p>\n<p>Incidents like the fatal Texas crash “are foreseeable incidents,” Levine said, “no matter how many disclaimers Tesla lawyers decide to insert in fine print.”</p>\n<p>Musk disbanded the company’s media relations department in 2019. Emails to the company were not returned.</p>\n<p>The California DMV is in a position to clarify matters but thus far has not. In previously undisclosed emails to the DMV in recent months, made public by the legal document transparency organization Plainsite, Tesla told the DMV that its system is not autonomous but a so-called Level 2 driver assist system.</p>\n<p>The DMVs own regulations bar companies from advertising sale or lease of a vehicle as autonomous if it “will likely induce a prudent person to believe a vehicle is autonomous.”</p>\n<p>In public presentations and slideshows, DMV Deputy Director Bernard Soriano described Level 4 automation, which requires no human driver, this way: “Full self-driving.”</p>\n<p>The DMV did not respond to a request for comment.</p>\n<p>Adding to the confusion, Musk himself has appeared on \"60 Minutes\" and Bloomberg TV behind the wheel of a Tesla with his hands in the air. He’s been talking about Tesla fully autonomous technology as if it’s imminent since 2016. That year, Tesla posted a video showing <a href=\"https://laohu8.com/S/AONE.U\">one</a> of its cars running in autonomous mode through Palo Alto. “The person in the driver’s seat is only there for legal reasons,\" the video said.</p>\n<p>The same year he announced a coast-to-coast test drive of an autonomous Tesla by the end of 2017, which as of April 2021 has not happened. He told a Shanghai conference in 2020 that the “basic functionality” for fully autonomous driving would be complete that year. It wasn’t. He said the company would have a million driverless robotaxis on the road by the end of 2020, which would cause Tesla cars to appreciate in value. So far there are none.</p>\n<p>The misleading promises and the confusing nomenclature are beginning to rile other players in the driverless car industry. Several industry executives have told The Times that they fear that Musk’s behavior could disturb the public and cause policymakers to enact restrictive laws and regulations that could unnecessarily delay the introduction of driverless cars.</p>\n<p>Now, some are beginning to speak out publicly.</p>\n<p>“We’ve had multiple years of claims that ‘by the end of the year it’s going to be magically self-driving by itself without a human in the car,’” Ford’s autonomous vehicles head, John Rich, said at a recent Princeton University conference. “It is not helpful, OK? It is confusing the public. Frankly even the investor community is very, very confused as to what paths are plausible and what the capabilities of the different systems are.”</p>\n<p>Musk has long cultivated a maverick approach to robot-car technologies. Other car and tech companies combine radar, lidar and visual sensors in their systems to identify and analyze a robot-car’s surroundings. Musk believes lidar is an unnecessary expense and recently announced Tesla would soon stop using radar, too, relying solely on visual sensors for the main driving task.</p>\n<p>And while other companies with advanced driver-assist systems similar to Autopilot use infrared cameras to make sure a human is in the driver’s seat and paying attention to the road ahead, Musk specifically rejected that technology in favor of a steering wheel sensor that can be easily defeated by hanging a weight off the wheel or jamming an object into it.</p>\n<p>General Motors’ SuperCruise system, for example, allows hands-free driving and automated lane changing on interstates and other limited-access highways, but monitors the driver to ensure they’re paying attention to the driving task. If not, warning lights and sounds are deployed. If the driver remains inattentive, the car will exit traffic lanes and stop itself.</p>\n<p>Ford recently announced a similar product, BlueCruise, expected to become available later this year on Mustang Mach E electric cars and Ford F-150 pickups. According to police, one had been sitting in the front passenger seat, the other in the back of the car.\nWhile investigators have not said whether they believe Tesla’s Autopilot technology was steering, the men’s wives told local reporters the pair went out for a late-night drive Saturday drive after talking about the system. \nTesla Chief Executive Elon Musk pushed back on speculation but also asserted no conclusion, tweeting Monday that \"Data logs recovered so far show Autopilot was not enabled.\" The company has resisted sharing data logs for independent review without a legal order. \nFollowing Musk's tweet, a county police official told Reuters that the department would serve a warrant for the data.\nAutopilot technically requires the human driver to pay full attention, but it’s easy to cheat the system, and the internet is rife videos of pranksters sitting in the back while a Tesla cruises down the highway with the driver seat empty.\nIt's a state of affairs that leaves many auto safety experts and driverless technology advocates wondering just what it will take before regulators step in and put an end to the word games and rule-skirting that have allowed it to continue. Could the crash in Houston provide that impetus?\n“I suspect there will be big fallout from this,” said Alain Kornhauser, head of the driverless car program at Princeton University. \nTesla’s Autopilot system has been involved in several fatal crashes since 2016, when a Florida man was decapitated as a Tesla on Autopilot drove him under the trailer of a semi truck. Less lethally, Teslas have slammed into the back of fire trucks, police cars and other vehicles stopped on highway lanes.\nYet little action has been taken by federal safety officials and none at all by the California Department of Motor Vehicles, which has allowed Tesla to test its autonomous technology on public roads without requiring that it conform to the rules that dozens of other autonomous tech companies are following.\nThe National Highway Traffic Safety Administration said Monday that it had dispatched a “Special Crash Investigation team” to Texas. The agency, an arm of the U.S. Department of Transportation, said it “will take appropriate steps when we have more information.”\nThe agency declined to speak with The Times about what those steps might be.\nSince 2016, NHTSA has launched investigations into at least 23 crashes involving Autopilot; but if they resulted in any conclusion or action, NHTSA hasn’t told the public about it.\nJason Levine, executive director of the Center for Auto Safety, thinks it’s about time that changes. \n“There doesn’t seem to be much activity coming out of our federal safety administration with respect to what is pretty evidently becoming a public danger,” he said. “You’ve got the market getting ahead of regulators, which isn’t uncommon, but this all didn’t start yesterday.”\nTesla sells an enhanced version of Autopilot called Full Self-Driving Capability for $10,000, although there is no car sold anywhere in the world today that is capable of full self-driving.\n\n\n\n A search for \"full-self driving definition\" on Google turns up this snippet. \n \n\nAlthough Tesla technology might well be safe when used as directed, Tesla’s marketing can lead people to believe the car is capable of autonomous driving. NHTSA, Levine points out, has rules against “predictable abuse” in automotive technology. \n“It is predictable when you call something Autopilot it means autopilot, and when you call something Full Self-Driving it means full self-driving,” he said. \nIncidents like the fatal Texas crash “are foreseeable incidents,” Levine said, “no matter how many disclaimers Tesla lawyers decide to insert in fine print.”\nMusk disbanded the company’s media relations department in 2019. Emails to the company were not returned.\nThe California DMV is in a position to clarify matters but thus far has not. In previously undisclosed emails to the DMV in recent months, made public by the legal document transparency organization Plainsite, Tesla told the DMV that its system is not autonomous but a so-called Level 2 driver assist system.\nThe DMVs own regulations bar companies from advertising sale or lease of a vehicle as autonomous if it “will likely induce a prudent person to believe a vehicle is autonomous.”\nIn public presentations and slideshows, DMV Deputy Director Bernard Soriano described Level 4 automation, which requires no human driver, this way: “Full self-driving.”\nThe DMV did not respond to a request for comment.\nAdding to the confusion, Musk himself has appeared on \"60 Minutes\" and Bloomberg TV behind the wheel of a Tesla with his hands in the air. He’s been talking about Tesla fully autonomous technology as if it’s imminent since 2016. That year, Tesla posted a video showing one of its cars running in autonomous mode through Palo Alto. “The person in the driver’s seat is only there for legal reasons,\" the video said.\nThe same year he announced a coast-to-coast test drive of an autonomous Tesla by the end of 2017, which as of April 2021 has not happened. He told a Shanghai conference in 2020 that the “basic functionality” for fully autonomous driving would be complete that year. It wasn’t. He said the company would have a million driverless robotaxis on the road by the end of 2020, which would cause Tesla cars to appreciate in value. So far there are none.\nThe misleading promises and the confusing nomenclature are beginning to rile other players in the driverless car industry. Several industry executives have told The Times that they fear that Musk’s behavior could disturb the public and cause policymakers to enact restrictive laws and regulations that could unnecessarily delay the introduction of driverless cars.\nNow, some are beginning to speak out publicly.\n“We’ve had multiple years of claims that ‘by the end of the year it’s going to be magically self-driving by itself without a human in the car,’” Ford’s autonomous vehicles head, John Rich, said at a recent Princeton University conference. “It is not helpful, OK? It is confusing the public. Frankly even the investor community is very, very confused as to what paths are plausible and what the capabilities of the different systems are.”\nMusk has long cultivated a maverick approach to robot-car technologies. Other car and tech companies combine radar, lidar and visual sensors in their systems to identify and analyze a robot-car’s surroundings. Musk believes lidar is an unnecessary expense and recently announced Tesla would soon stop using radar, too, relying solely on visual sensors for the main driving task.\nAnd while other companies with advanced driver-assist systems similar to Autopilot use infrared cameras to make sure a human is in the driver’s seat and paying attention to the road ahead, Musk specifically rejected that technology in favor of a steering wheel sensor that can be easily defeated by hanging a weight off the wheel or jamming an object into it.\nGeneral Motors’ SuperCruise system, for example, allows hands-free driving and automated lane changing on interstates and other limited-access highways, but monitors the driver to ensure they’re paying attention to the driving task. If not, warning lights and sounds are deployed. If the driver remains inattentive, the car will exit traffic lanes and stop itself.\nFord recently announced a similar product, BlueCruise, expected to become available later this year on Mustang Mach E electric cars and Ford F-150 pickups.
