3的“准车主”在看到特斯拉刹车失灵案件后，选择继续观望一段时间，“而且国产电动汽车品牌也有不错的，可能会选择它们”。\n“所有的产品可能都会出现问题，有些我觉得大家能接受。”在董维看来，最让人接受不了的是出现问题时，就把锅甩到提出问题的人身上。此前他也曾遇到过刹车踩不动的情况，幸运的是距离前车较远，车速也不快，后来车辆逐渐停到路边后恢复了正常。\n\n“我不确定下一秒会不会给我带来什么意外，通过比较复杂路段时，就会把这速度降得特别慢。”现在董维的车尾两个车贴醒目地写着——刹车失灵，路人勿近；转向失控，旁人勿扰。\n2\n“刹车失灵”原因或无从解答\n面对舆论压力，自4月19日以来，特斯拉官方微博几乎每天都会更新“刹车失灵”事件的处理进展，对于广州增城和福建厦门发生的两起事故也分别发布声明。有网友吐槽，特斯拉应该成立一个专门的事故宣发小组，毕竟特斯拉的积极回应也没有浇灭维权者的质疑。\n4月22日，针对车展维权张女士车辆失控事故，特斯拉公布了事故发生前一分钟的数据，坚持否认“刹车失灵”。特斯拉认为，车辆以118.5km/h的较高速度行驶，驾驶员开始踩下制动踏板力度较轻，随着车主深踩刹车，自动刹车系统开启后，车速最终降至48.5km/h，随后撞车事故发生。\n该数据也让特斯拉越描越黑。工信部新能源与智能网联汽车产业专家智库成员张翔告诉未来汽车日报，目前特斯拉公布的数据缺少一些刹车传感器、制动踏板传感器等关键数据，“该数据并没有公信力，是在转移转移视线或者是拖延时间，并不能证明特斯拉自己的清白”。\n\n现身上海车展现场维权的西安车主事故现场\n和传统燃油车不同，特斯拉作为智能电动汽车，整个刹车制动过程既有软件决策参与，也包含人为因素。若要还原车主踩刹车的过程，包括电机、整车控制器、踏板深度传感器以及踏板开关等数据都需要放到一块分析，只有这样才能综合判断出到底是人为因素刹车力度不足，还是车辆刹车失灵。\n这也体现出行车数据的重要性。目前特斯拉车辆配备的EDR（Event Data Recorder，事故数据记录器）中包含制动数据、安全系统以及电子制动信息等诸多数据，该功能类似飞机上的“黑匣子”。不过目前来看，特斯拉并没有公布更多的详细数据，这也成为外界断定其“刹车失灵”实锤的关键要素。\n事实上，抛开特斯拉公布的不完整数据，目前“刹车失灵”本身仍有诸多的疑点。张翔表示，特斯拉的自动驾驶有感知层、决策层和执行层三个技术层面。目前包括刹车片在内的硬件属于执行层，其技术已经非常成熟，问题可能在于特斯拉传感器的感知层，但由于没有数据仍不能确定是具体哪个环节出现了问题。\n一位汽车零部件从业人员告诉未来汽车日报，在硬件方面，特斯拉集成线束的新技术也有可能出现问题。一直以来，特斯拉都在致力于减少线束长度，汽车线束作为汽车电路的网络主体，承担着连接汽车电气设备的功能，一旦出现问题，就会导致车辆控制出现故障。\n\nNHTSA调查特斯拉碰撞事故 来源：NHTSA\n美国国家公路交通安全管理局（NHTSA）曾针对特斯拉“失控加速”展开调查，在历时一年之久的调查期后，NHTSA于2021年1月8日公布了相关的调查结果。调查显示，246例特斯拉失控加速事件，都是因为驾驶者错踩踏板造成的驾驶事故。这也意味着在车祸事件中，有人为操作失误的因素。\n为什么特斯拉的车辆容易操作失误？原因之一在于其单踏板模式，单踏板模式是通过电门踏板就能控制车辆的启动、加速、减速和停止，这样通过反向电流进行动能回收，就能达到节能并提高续航的目的。清研华科新能源研究院增材研发中心主任张抗抗表示，这种驾驶模式和燃油车相比，在人机交互方面发生变化，也更容易出现误操作。\n“现在张女士的事故已经找不出来真相了。”张翔告诉未来汽车日报，如果要解决的话，一种方式就是把数据传到第三方数据平台，一种是在车上装有行车记录仪，“但现在没办法追踪当时的现场的真相，这个事情已经无解了。”\n3\n谁才是“裁判员”？\n随着车主和特斯拉在维权过程中的推拉扯皮，解决问题的关键方向——行车数据权限及其责任判定——开始逐渐清晰。\n复盘整个维权始末，车主最初要求特斯拉公开数据，特斯拉拒绝了这个请求。在舆论压力下特斯拉公布了行车数据，但车主家属认为数据不充分，并指责特斯拉侵犯个人隐私，要求撤销数据，同时不接受特斯拉指定的第三方检测机构。\n事实上，“现在并没有权威的第三方检测机构能够检测智能汽车的交通事故责任问题”，张翔告诉未来汽车日报，对于传统燃油车来说，发生追尾撞车基本就是车主的责任，但是智能汽车在行驶过程中，高级辅助驾驶系统会参与开车，一旦发生发生事故，车企就要承担一定的责任。但目前来看，“国家还没有出台对带有自动驾驶功能的智能汽车的法律法规，车主与车企的责任很难厘清。”\n目前部分城市已经有了新能源行车数据记录平台，以上海为例，在该地区上牌的新能源汽车的数据都会被记录在上海市新能源汽车公共数据采集与检测研究中心。官方数据显示，截至目前，已经接入车辆的数量近42万辆，每辆汽车的发动机数据、报警数据以及电池数据等都能实时跟踪。\n\n“如果特斯拉想上传数据，应该是很简单的事，但他们并没有那么做。”张翔分析，目前特斯拉的自动驾驶技术在全球范围是领先的，但其软件系统也不算完善，容易出现BUG，数据一旦公开，外界就会很容易找到其漏洞。在他看来，特斯拉没有将数据上传至第三方平台，导致车企既是运动员又是裁判员，“自己管理数据然后再拿出来，无异于监守自盗，并没有公信力”。\n和燃油车可通过OBD接口获取行车辆信息不同，具备高级辅助驾驶功能的智能汽车需要对行车数据进行分析再应用。这很大程度上属于企业保密信息，普通车主很难获取。\n针对车主家属指责特斯拉侵犯个人隐私，太琨律创始合伙人朱界平律师告诉未来汽车日报，目前智能汽车数据的监管主体不明确，数据的真实性如何确定存在问题，另外智能汽车数据的确权以及权利的归属也没有明确的法律规定，“所以自动驾驶的数据归属，目前法律规定还不够明确”。\n朱界平表示，国家应强制车企将获取的数据进行不可修改的存储，或将形成的数据在至少两家以上的第三方机构存储，确保数据安全的目的在于合理、充分地使用数据。上海申伦律师事务所夏海龙也对未来汽车日报表达了同样的看法，其认为监管机构可以与车企探讨大数据的第三方托管和共享机制，通过不断提高大数据的利用效能，逐步明晰车主数据的采集规范。\n随着维权事件频发，智能汽车行业的监管漏洞也逐渐显现。此次特斯拉首次在国内公开行车数据，也凸显出厘清行车数据在智能汽车事故中责任的重要性。\n可以确定的是，特斯拉遭遇的问题并不是个案，安全性问题再怎么重视都不为过。而为了能使用户真正地放心体验、购买智能汽车，车企和行业需要做的还有很多。","news_type":1,"symbols_score_info":{"TSLA":0.9}},"isVote":1,"tweetType":1,"viewCount":3017,"authorTweetTopStatus":1,"verified":2,"comments":[],"imageCount":0,"langContent":"EN","totalScore":0}],"lives":[]}
