Police identified the man as Gustavo Arnal.</p><p>The police statement did not provide further details on the circumstances leading to Arnal's death and said the New York City Medical Examiner's Office would determine the cause of death. Bed Bath & Beyond confirmed his death in a press statement on Sunday but gave no details.</p><p>The big-box chain - once considered a so-called "category killer" in home and bath goods - has seen its fortunes falter after an attempt to sell more of its own brand, or private-label goods.</p><p>Last week, Bed Bath & Beyond said it would close 150 stores, cut jobs and overhaul its merchandising strategy in an attempt to turn around its money-losing business.</p><p>It forecast a bigger-than-expected 26% slump in same-store sales for the second quarter and said it would retain its buybuy Baby business, which it had put up for sale.</p><p class=\"t-img-caption\"><img src=\"https://static.tigerbbs.com/6673c2345ef368c2b571404fb4e108b2\" tg-width=\"960\" tg-height=\"640\" width=\"100%\" height=\"auto\"/><span>Signage is seen at a Bed Bath & Beyond store in Manhattan, New York City, U.S., June 29, 2022. The sales amounted to about $1.4 million, and Arnal still had almost 255,400 shares remaining.</p><p>On Aug. 23, the company, Arnal and major shareholder Ryan Cohen were sued over accusations of artificially inflating the firm's stock price in a "pump and dump" scheme, with the lawsuit alleging Arnal sold off his shares at a higher price after the scheme.</p><p>The class action lawsuit listed Arnal as one of the defendants and was brought by a group of shareholders who claimed they lost around $1.2 billion.</p><p>The filing in the U.S. District Court for the District of Columbia alleged that Arnal "agreed to regulate all insider sales by BBBY's officers and directors to ensure that the market would not be inundated with a large number of BBBY shares at a given time."</p><p>The lawsuit also alleged that he issued materially misleading statements to investors.</p><p>The company said it was "in the early stages of evaluating the complaint, but based on current knowledge the company believes the claims are without merit."</p><p>Shares in Bed Bath & Beyond have been highly volatile in recent months, being viewed as a so-called "meme" stock, which trade more on social media sentiment than economic fundamentals.</p><p>Cohen, a billionaire investor, disclosed a stake of nearly 10% in early March. Amazon shares fell more than 10% from when it announced the split to the day it became effective, while Alphabet lost 21% between those events.</p><p><img src=\"https://static.tigerbbs.com/159b610c103e0b3b445bf5c4a7246b7e\" tg-width=\"930\" tg-height=\"523\" width=\"100%\" height=\"auto\"/></p><p>âThe stock split smoke-and-mirror boost is much more prevalent in a bull market when retail investors rush into stocks,â said Greg Martin, managing director and co-founder of Rainmaker Securities. âIn bear markets retail investors tend to be less involved and the institutional players would never be fooled by a stock split to move into a stock.â</p><p>Shares of the Elon Musk-led company fell 12% through Wednesdayâs close since late-March when it declared its plan for a split, a far cry from 2020 when the stock surged 60% from announcement to the last close prior to the beginning of split-adjusted trading.</p><p>The shares rose as much as 2% at the open in New York, before slipping and turning negative. They traded at $295.31 as of 9:42 a.m., compared with the previous close of $297.10 after adjusting for the split.</p><p>Riskier growth stocks like Tesla have borne the brunt of a souring equities market mood this year amid the threat of a recession. The stock is down 14% year-to-date, headed for its first annual decline since 2016. And having rallied 42% through Wednesdayâs close since hitting a year low on May 24, the rebound has hit a wall in August as broader enthusiasm among retail investors has started to flag again.</p><p>According to Vanda Research, investors tend to âdrastically scale backâ purchases of stocks in the weeks after a split takes effect. The firm doesnât believe it will be any different for Tesla this time round, it said in a note.</p><p><b>Highly Valued</b></p><p>In addition to a tentative investor mood, the stockâs eye-watering valuation may also make gains harder to come by. Tesla trades at about 58 times forward earnings estimates compared with 18 times for the S&P 500 Index. And the average analyst price target implies a decline of about 4% over the next 12 months, even as the benchmark index is expected to rise more than 15%.</p><p>âThere is a lot of hope, speculation, hero worship in the current valuation,â said Catherine Faddis, chief investment officer of Grace Capital. In order to buy the stock right now, an investor needs to believe that in 10 years Tesla will have revenue of $800 billion, Faddis said, almost 10 times estimates for this year.</p><p>Then there is the companyâs litany of challenges -- production troubles in China, the persisting supply-chain shortages across the automotive industry and high raw material costs, as well as Muskâs litigation with Twitter Inc. -- that can dull the shine of any potential exuberance driven by the split.</p><p>Still, Teslaâs strong popularity with the mom-and-pop investing crowd can ensure a short-term bump in the stock, if wider investor sentiment improves again.</p><p>âA strong retail following is the key ingredient for a stock split to make a difference,â said Martin of Rainmaker Securities, adding that Teslaâs timing for the split may prove to be lucky as the climate act will âcreate substantial new demand for electric vehicles and Tesla is the market leader in the EV market.â</p><p><b>Tech Chart of the Day</b></p><p><img src=\"https://static.tigerbbs.com/5a1da2f2d6d936ffc68f8357875f5a15\" tg-width=\"957\" tg-height=\"606\" width=\"100%\" height=\"auto\"/></p><p>After Tesla executed its split there are now only eight Nasdaq 100 components with stocks priced at more than $500. Crucially: he was also a longstanding employee of JPMorgan Chase & Co., the biggest bullion bank.</p><p>The FBIâs airport ambush described by Trunz was a crucial step in the pursuit by US prosecutors of JPMorganâs precious metals desk, leading up to last weekâs climax â the conviction on 13 counts of the man who was once the most powerful figure in the gold market, the deskâs former global head Michael Nowak.</p><p class=\"t-img-caption\"><img src=\"https://static.tigerbbs.com/ebbadecc1f5c7943a399026a1c4b692e\" tg-width=\"1000\" tg-height=\"666\" width=\"100%\" height=\"auto\"/><span>Michael Nowak departs from federal court in Chicago, Illinois, US, on July 8.Photographer: Cheney Orr/Bloomberg</span></p><p>Watched with a mixture of fascination and horror by precious metals traders around the world, the case has shone a light on how JPMorganâs traders â including Nowak and the bankâs long-time lead gold trader Gregg Smith â for years allegedly manipulated markets by placing bogus orders designed to wrongfoot other market participants, principally algorithmic traders whose high-speed activity became a major source of frustration.</p><p>Nowak has become one of the most senior bankers to be convicted in the US since the financial crisis, and faces the prospect of decades in prison, although it could be far less.</p><p>Nowakâs lawyers contend Nowak wasnât a âcriminal mastermindâ and said they will âcontinue to vindicate his rights in court.â A lawyer for Smith said during closing arguments last month that his clientâs orders were legitimate, and there are other explanations to buy and sell futures contracts at the same time on behalf of customers.</p><p>It took three weeks in court for the government to persuade a jury of Nowak and Smithâs guilt. (Jeffrey Ruffo, a salesman who was tried with them, was acquitted.)</p><p>But whispers of spoofing had hung over JPMorganâs trading desk for at least a decade â many years before the FBI first approached Trunz in 2018.</p><p class=\"t-img-caption\"><img src=\"https://static.tigerbbs.com/48b77891e950996fa6e33cdf27373856\" tg-width=\"1000\" tg-height=\"666\" width=\"100%\" height=\"auto\"/><span>Gregg Smith, center, departs from federal court in Chicago.Photographer: Cheney Orr/Bloomberg</span></p><p>Alex Gerko, the head of an algorithmic trading firm, complained about Smithâs activity in the gold market as early as 2012 to CME Group Inc., which owns the futures exchanges where the US alleged thousands of spoof trades took place. But Smith and Nowak continued working at the bank until 2019, when the US unsealed charges against them.</p><p>âThe wheels of justice are moving, slowly,â Gerko tweeted last month.</p><p>At the Justice Department, the road to JPMorgan began with a decision to begin hunting down traders who made bogus offers to buy and sell commodities that they never intended to execute. The criminal fraud unit hired data consultants to go through billions of lines of trades to spot patterns of market manipulators.</p><p>As the vast quantities of data was scrutinized, there were certain traders that stood out. And they worked at JPMorgan.</p><p class=\"t-img-caption\"><img src=\"https://static.tigerbbs.com/a0bd52c3148093101f269bba08842701\" tg-width=\"1000\" tg-height=\"666\" width=\"100%\" height=\"auto\"/><span>JPMorgan Chase & Co. headquarters in New York.Photographer: Michael Nagle/Bloomberg</span></p><p>With the data in hand, investigators went looking for cooperators, which they found in Trunz and his former colleague John Edmonds. Both relatively junior traders pleaded guilty to their own misconduct and agreed to testify against the deskâs boss.</p><p>Nowak was arrested in September 2019, sending a shock wave through the metals world, but the Covid pandemic meant it would be another three years until the trial finally took place.</p><p>In his testimony, Edmonds, whoâd started in an operations role at JPMorgan, described spoofing on the desk as a daily phenomenon and felt obliged to take part because it was part of the normal strategy.</p><p>The Justice Departmentâs move against JPMorganâs most senior bullion bankers was celebrated in some corners of the gold and silver markets, where investors and bloggers have long accused the bank of a large-scale scheme to manipulate prices lower. Those allegations prompted multiple investigations by the Commodity Futures Trading Commission, the most recent of which was closed in 2013 after finding no evidence of wrongdoing.</p><p>The case against Nowak and Smith made no allegations of a systematic plot to suppress prices, instead arguing that they spoofed markets over very short periods of time, and in both directions, to benefit JPMorgan's most important hedge fund clients.</p><p>And while the convictions are a victory for the prosecutors, the jury rejected the governmentâs most sweeping charges â brought under the Racketeer Influenced and Corrupt Organizations Act, or RICO â that the men were part of a conspiracy and that JPMorganâs precious metals desk was a criminal enterprise.</p><p>At JPMorgan, Edmonds said the practice was referred to as âclickingâ rather than spoofing, and the traders never discussed it as being illegal despite the firmâs own compliance policies making it plain. Trunz even spoke of a running joke involving Smith, who would click his mouse so fast to place and cancel orders that his colleagues would urge him to put ice on his fingers.</p><p>In 2012, Gerko, who is the founder of quantitative trading firm XTX Markets Ltd., complained to the CME about Smithâs trading in gold futures by rapidly entering and canceling orders. The CME began an investigation, which dragged on for three years before concluding heâd likely been spoofing.</p><p class=\"t-img-caption\"><img src=\"https://static.tigerbbs.com/49cfd54d19cd90838798de601eaa2eea\" tg-width=\"1000\" tg-height=\"667\" width=\"100%\" height=\"auto\"/><span>Alex GerkoPhotographer: Rahul Singh/XTX Markets Ltd.</span></p><p>âIt took a long time after 2010 to get consistent enforcement,â Gerko said in a tweet, referring to the Dodd-Frank act in which spoofing was defined and made illegal.</p><p>After another JPMorgan trader, Michel Simonian, was fired in 2014 for spoofing, Nowak called his traders into his office to ask if they'd been doing the same, according to Edmonds. No one said anything. The incident shocked Edmonds, he said, as Nowak knew it had been going on for years.</p><p>During the trial, Nowak appeared largely impassive, his face hidden behind a Covid mask. Industry insiders described him in 2020 as introverted and brainy, and testimony during the trial painted him as a well-liked manager, who became friendly with Trunz while the two did a stint working out of JPMorganâs London office.</p><p>During trial, Trunz was asked whether he liked Nowak, the former trader responded: "I loved him."</p><p>However, the relationship became more complicated after Trunz was approached by authorities. When he contemplated making a deal with the government, Nowak told him not to, according to Trunz, who became audibly choked up as he gave the testimony.</p><p>Defense lawyers painted Trunz and Edmonds as unreliable â proven liars who were testifying against their clients in order to avoid lengthy prison sentences.</p><p>Nowak and Smith wonât be sentenced until next year. For comparison, two Deutsche Bank AG traders convicted of spoofing in 2020 were each sentenced to about a year in prison.</p><p>Last weekâs conviction represents the pinnacle of the US Justice Departmentâs crackdown on the illegal trading practice known as spoofing. So far, prosecutors have managed to convict ten traders at five different banks.</p><p>JPMorgan has already paid $920 million to settle spoofing allegations against it.</p><p>âEven though the jury rejected the conspiracy and RICO charges, they will consider this a win,â said Matthew Mazur, an attorney at Dechert LLP who defended one of the Deutsche Bank traders. âThis is probably the end of the precious metals sweep that was done, but I do think there will continue to be cases.â</p><p>Even after the crackdown, some market participants say spoofing still takes place. Back when commodity futures traded in the pits, brokers had to trade face-to-face. Crucially: he was also a longstanding employee of JPMorgan Chase & Co., the biggest bullion bank.The FBIâs airport ambush described by Trunz was a crucial step in the pursuit by US prosecutors of JPMorganâs precious metals desk, leading up to last weekâs climax â the conviction on 13 counts of the man who was once the most powerful figure in the gold market, the deskâs former global head Michael Nowak.Michael Nowak departs from federal court in Chicago, Illinois, US, on July 8.Photographer: Cheney Orr/BloombergWatched with a mixture of fascination and horror by precious metals traders around the world, the case has shone a light on how JPMorganâs traders â including Nowak and the bankâs long-time lead gold trader Gregg Smith â for years allegedly manipulated markets by placing bogus orders designed to wrongfoot other market participants, principally algorithmic traders whose high-speed activity became a major source of frustration.Nowak has become one of the most senior bankers to be convicted in the US since the financial crisis, and faces the prospect of decades in prison, although it could be far less.Nowakâs lawyers contend Nowak wasnât a âcriminal mastermindâ and said they will âcontinue to vindicate his rights in court.â A lawyer for Smith said during closing arguments last month that his clientâs orders were legitimate, and there are other explanations to buy and sell futures contracts at the same time on behalf of customers.It took three weeks in court for the government to persuade a jury of Nowak and Smithâs guilt. But Smith and Nowak continued working at the bank until 2019, when the US unsealed charges against them.âThe wheels of justice are moving, slowly,â Gerko tweeted last month.At the Justice Department, the road to JPMorgan began with a decision to begin hunting down traders who made bogus offers to buy and sell commodities that they never intended to execute. The criminal fraud unit hired data consultants to go through billions of lines of trades to spot patterns of market manipulators.As the vast quantities of data was scrutinized, there were certain traders that stood out. Both relatively junior traders pleaded guilty to their own misconduct and agreed to testify against the deskâs boss.Nowak was arrested in September 2019, sending a shock wave through the metals world, but the Covid pandemic meant it would be another three years until the trial finally took place.In his testimony, Edmonds, whoâd started in an operations role at JPMorgan, described spoofing on the desk as a daily phenomenon and felt obliged to take part because it was part of the normal strategy.The Justice Departmentâs move against JPMorganâs most senior bullion bankers was celebrated in some corners of the gold and silver markets, where investors and bloggers have long accused the bank of a large-scale scheme to manipulate prices lower. Those allegations prompted multiple investigations by the Commodity Futures Trading Commission, the most recent of which was closed in 2013 after finding no evidence of wrongdoing.The case against Nowak and Smith made no allegations of a systematic plot to suppress prices, instead arguing that they spoofed markets over very short periods of time, and in both directions, to benefit JPMorgan's most important hedge fund clients.And while the convictions are a victory for the prosecutors, the jury rejected the governmentâs most sweeping charges â brought under the Racketeer Influenced and Corrupt Organizations Act, or RICO â that the men were part of a conspiracy and that JPMorganâs precious metals desk was a criminal enterprise.At JPMorgan, Edmonds said the practice was referred to as âclickingâ rather than spoofing, and the traders never discussed it as being illegal despite the firmâs own compliance policies making it plain. Trunz even spoke of a running joke involving Smith, who would click his mouse so fast to place and cancel orders that his colleagues would urge him to put ice on his fingers.In 2012, Gerko, who is the founder of quantitative trading firm XTX Markets Ltd., complained to the CME about Smithâs trading in gold futures by rapidly entering and canceling orders. No one said anything. The incident shocked Edmonds, he said, as Nowak knew it had been going on for years.During the trial, Nowak appeared largely impassive, his face hidden behind a Covid mask. Industry insiders described him in 2020 as introverted and brainy, and testimony during the trial painted him as a well-liked manager, who became friendly with Trunz while the two did a stint working out of JPMorganâs London office.During trial, Trunz was asked whether he liked Nowak, the former trader responded: \"I loved him.\"However, the relationship became more complicated after Trunz was approached by authorities. When he contemplated making a deal with the government, Nowak told him not to, according to Trunz, who became audibly choked up as he gave the testimony.Defense lawyers painted Trunz and Edmonds as unreliable â proven liars who were testifying against their clients in order to avoid lengthy prison sentences.Nowak and Smith wonât be sentenced until next year. For comparison, two Deutsche Bank AG traders convicted of spoofing in 2020 were each sentenced to about a year in prison.Last weekâs conviction represents the pinnacle of the US Justice Departmentâs crackdown on the illegal trading practice known as spoofing. So far, prosecutors have managed to convict ten traders at five different banks.JPMorgan has already paid $920 million to settle spoofing allegations against it.âEven though the jury rejected the conspiracy and RICO charges, they will consider this a win,â said Matthew Mazur, an attorney at Dechert LLP who defended one of the Deutsche Bank traders. âThis is probably the end of the precious metals sweep that was done, but I do think there will continue to be cases.âEven after the crackdown, some market participants say spoofing still takes place. Thus, let's dive into the solid Business Model, Financials and Valuation for this Tech Titan.</p><h2><b>Solid Business Model</b></h2><p>Microsoft's mission to "empower every person and organization" on the planet to achieve more. It accomplishes this through its robust business model, which can be divided into three main segments.</p><ol><li>Productivity and Business Processes</li><li>Intelligent Cloud</li><li>More Personal Computing</li></ol><h4>i. Productivity and Business</h4><p>The Productivity suite includes Microsoft Office 365 which had approximately 345 million paid seats as of the first quarter of 2022. This was up a blistering 72% since the 200 million paid seats in early 2020. This growth was driven by the need for enterprises to offer secure and fast remote working to employees. Microsoft Teams had 270 million monthly active users (as of Q421) which makes it one of the most popular Video conferencing platform in the world. <a href=\"https://laohu8.com/S/ZM\">Zoom</a> (ZM) reportedly has 300 million daily active users and thus may be slightly ahead, although the data on exact users is scarce. The world's number one professional social network LinkedIn is also part of Microsoft and saw revenue growth of 34% YoY, driven by a strong job market.</p><h4><b>ii. Intelligent Cloud</b></h4><p>Microsoft Azure is the 2nd largest cloud provider globally with a 21% market share as of Q421. The global cloud computing market was worth $445 billion in 2021 and is forecasted to grow at 16.3% CAGR to nearly $1 trillion by 2026. Microsoft's Cloud segment has historically grown faster than the industry with a 29% growth rate achieved for the quarter ending in March 2022. Azure benefits from economies of scale as a big three cloud provider. They can deploy computational resources at a lower cost per unity and thus have a strong moat despite offering what seemingly is a commodity (computing resources).</p><p>The "Intelligent Edge" is also another growth driver which aims to bring the power of the data centre locally to IoT (Internet of Things) devices. This is set to enable a host of new applications where live data transfer is a necessity to the experience. The Virtual reality industry is forecasted to grow from $16.7 billion in 2022 to over $227 billion by 2029, expanding by a blistering CAGR of 45%.</p><p></p><p><img src=\"https://static.tigerbbs.com/268289d87b43ab0c19849733db96a019\" tg-width=\"640\" tg-height=\"399\" referrerpolicy=\"no-referrer\" width=\"100%\" height=\"auto\"/></p><p>Microsoft Mesh Hologram preview (Microsoft)</p><p>With regards to Headsets, Meta's Oculus is leading the pack in VR headsets with an 80% market share as of Q421. However, I believe Microsoft HoloLens can carve out a substantial gap in the Enterprise and Manufacturing industry. According to a recent review of the latest HoloLens vs Oculus, they state:</p><blockquote>"With the Microsoft HoloLens 2, engineers can overlay information about a machine onto the device itself and see instructions in front of them, without having to search through a manual.</blockquote><blockquote>If you're hoping to empower professionals in the field, support specialists in challenging environments, and enable more immersive creative experiences, the HoloLens 2 is the right pick".</blockquote><p>Back in college I designed an early prototype of a similar augmented reality solution which was used by the manufacturing industry thus you could say I have roots in the market. Today, HoloLens is used by the world's largest automotive company (by volume) Toyota (TM) for vehicle repairs, training of employees and maintenance. Although the whole idea of the "Metaverse" is still yet to materialise into real revenues it offers low risk optionality in Microsoft's stock. Whereas, with a company like Meta Platforms, they are literally betting the future of "Facebook" on the idea, which is more risky for investors.</p><h2>Roaring Financials</h2><p>Microsoft announced strong earnings for the quarter ending March 31st 2022. It generated revenue of $49.4 billion, up a blistering 18% year over year. This revenue growth was driven by the rapidly growing cloud segment which increased by 26% to $19.1 billion or 40% of revenues. Productivity and Business Process revenue popped by 17% to $15.8 billion. This was driven by strong growth (17%) in Office 365 commercial revenue and Dynamics 365 which increased by 35%.
