When the nonprofits receive the money, it comes from the DAF, not the donor, and there's no paper trail connecting the donor directly to the nonprofit.DAFs have come under fire because account holders get a tax break when they put money into a DAF, but there's no deadline for when donors must distribute the money to charities. A bill recently introduced in Congress would change some of the laws around DAFs with the aim of moving money more quickly into the hands of charities.\"The Musk donation serves as a reminder that current laws allow for donors to get a tax deduction up front without any requirement that $ ever gets to the community,\" wrote billionaire John Arnold, a supporter of the DAF reform legislation, on Twitter. \"Money can sit in DAF accounts forever.\"DAF providers say those criticisms are wrong. On the data center side, we have heard from several companies that data center trends are very strong, which should benefit Nvidia.&#34;</p><p><b>Now what</b></p><p>In short, Piper Sandler is predicting that Nvidia will exceed expectations for 48% quarterly revenue growth and 58% earnings growth in its fourth-quarter report. But it&#39;s also predicting that the company will continue growing over the long term because the cyclical semiconductors industry is only in the early stages (or at worst, the middle) of its cycle of rising demand for chips, a cycle that should keep on growing for a few more years.</p><p>Assuming Piper is right, Nvidia is likely to comment on this trend in its earnings report tomorrow afternoon, and probably will raise guidance right after reporting on earnings. The statement dealt a fresh blow to markets.</p><p>“The Russia-Ukraine tensions have hovered over already shaky investor sentiment,” Comerica Wealth Management Chief Investment Officer John Lynch said in a note. “Investors have been counting on a diplomatic resolution, but recent developments indicate this may be wishful thinking and therefore, not fully priced into the markets.”</p><p>The geopolitical tensions add to the uncertainty around central bank policy that has dominated market sentiment in recent months. Friday’s warning by the Biden administration weighed on stocks and sent oil prices soaring to a seven-year high.</p><p>“By pushing energy prices even higher, a Russian invasion would likely exacerbate inflation and redouble pressure on the Fed to raise interest rates,” Comerica Bank Chief Economist Bill Adams said in a note. “From the Fed’s perspective, the inflationary effects of a Russian invasion and higher energy prices would likely outweigh the shock’s negative implications for global growth.”</p><p>The Fed is already under pressure to act on the fastest increase in prices in 40 years. Wall Street was rattled last week by a highly-anticipated fresh print on the Labor Department’s Consumer Price Index (CPI), which notched a steeper-than-expected 7.5% increase over the year ended January to mark the largest annual jump since 1982. The surge heightened calls for the Federal Reserve to intervene more aggressively than anticipated to rein in soaring price levels, even raising the possibility of an emergency hike before the bank’s next policy meeting in March.</p><p>“As the inflation fire burns even hotter, the Federal Reserve will have to bring an even bigger firehose to put it out,” FWDBONDS Chief Economist Chris Rupkey said in a note.</p><p>Worries over above-estimated inflation have raised questions about whether or not the central bank might deliver on a 50 basis point move in mid-March. The statement dealt a fresh blow to markets.“The Russia-Ukraine tensions have hovered over already shaky investor sentiment,” Comerica Wealth Management Chief Investment Officer John Lynch said in a note. “Investors have been counting on a diplomatic resolution, but recent developments indicate this may be wishful thinking and therefore, not fully priced into the markets.”The geopolitical tensions add to the uncertainty around central bank policy that has dominated market sentiment in recent months. Friday’s warning by the Biden administration weighed on stocks and sent oil prices soaring to a seven-year high.“By pushing energy prices even higher, a Russian invasion would likely exacerbate inflation and redouble pressure on the Fed to raise interest rates,” Comerica Bank Chief Economist Bill Adams said in a note. “From the Fed’s perspective, the inflationary effects of a Russian invasion and higher energy prices would likely outweigh the shock’s negative implications for global growth.”The Fed is already under pressure to act on the fastest increase in prices in 40 years. In 2021, Tesla recorded net income of $5.5 billion, and adjusted income of $7.6 billion.</p><p>But buried in a footnote of its recent annual financial filing with the Securities and Exchange Commission, Tesla reports that its US operations lost $130 million last year on a pre-tax basis. It claims that all of its pre-tax profits — more than $6 billion worth — came from overseas operations, even though 45% of its revenue came from US sales.</p><p>Although Tesla indicates its foreign tax bill came to $839 million, its state tax bill was only $9 million. And its federal tax bill was zero.</p><p>&#34;That defies common sense, but it does not defy the US tax code,&#34; said Martin Sullivan, chief economist for Tax Analysts, a nonprofit tax publisher, and an expert on US corporate tax practices.</p><p><b>Moving profits overseas — on paper</b></p><p>Sullivan said he believes the $130 million loss on its US operations is most likely due to a common practice for US multinational corporations: structuring their operations so that overseas subsidiaries are the ones reporting income, leaving the US operation to have little or no taxable income to report.</p><p>For example, a company can assign its intellectual property to one of those foreign entities, and charge its US unit a fee for using that property. And thus, the foreign operation is very profitable, while the US company — burdened with &#34;costs&#34; to the company itself — reports either a loss or very little income.</p><p>&#34;It&#39;s a US multinational thing. It&#39;s very common. It&#39;s almost malpractice not to do that,&#34; said Sullivan.</p><p>A recent report from the US Department of the Treasury found 61% of the international profits ofUS multinational companies are booked in seven small countries -- Bermuda, the Caymans, Ireland, Luxembourg, the Netherlands, Singapore and Switzerland -- known as tax havens. It&#39;s a practice that many elected officials and the Biden administration have vowed to crack down on.</p><p>&#34;Tesla and other giant corporations have long used scams and loopholes to help them get out of paying taxes -- that has to stop,&#34; said Sen. Elizabeth Warren, a frequent critic of Musk. &#34;Democrats are working to end Republican tax cuts for corporations shifting profits and jobs overseas.&#34;</p><p>However, Congress has so far failed to take action to stop it.</p><p>The financial filing by Tesla doesn&#39;t spell out what it did exactly, though. For example, it doesn&#39;t say which country or countries it made its profit in while reporting a US loss. And Tesla declined to respond to a question about its filing.</p><p><b>Tesla doesn&#39;t expect to pay US taxes any time soon</b></p><p>Considering the substantial financial help that Tesla has long received from government support for its electric cars, the company doesn&#39;t have to use a shell game of offshoring its profits to avoid paying taxes. Instead, it could use past losses to shelter its current income from any tax bill.</p><p>Once again, this is a common practice for companies that lose money: losses result in a future tax break.</p><p>Tech companies that lose money for years before turning a profit — such as Amazon(AMZN) — have used this technique. So have old line companies that have financial problems, such as all US airlines, which will probably not have to pay taxes for years to come after recording billions of dollars in losses during the pandemic — despite receiving billions in federal help.</p><p>Similarly, Tesla&#39;s US automaking competitors lost so much money in the first decade of this century that General Motors (GM) and Chrysler needed government bailouts. Despite those bailouts, neither company paid taxes for several years once they were again profitable.</p><p>Past losses are a huge and very valuable future tax benefit known as &#34;net operating loss carry-forwards.&#34;</p><p>Tesla was losing money for more than a decade before it finally started reporting net income in 2020. Those were real losses, which occurred when the costs of developing and building its cars in its early years far outstripped the money it could sell them for. It did so with the expectation that it would turn a profit in the future as demand increased and costs declined. That&#39;s exactly what happened.</p><p>But, in running up billions of dollars in losses, Tesla was able to accumulate net operating loss carry-forwards that it could use in the future.</p><p>Still, Tesla disclosed in this week&#39;s financial filing that it did not use any of those past losses to shield current income from taxes. And it took a bookkeeping maneuver that suggests it doesn&#39;t know if it will ever have to use those past losses to shield its US income.</p><p>Tesla is rather bullish about its future, expecting annual sales growth of 50% for the foreseeable future. If it believed that its pre-tax losses in its domestic operations was temporary, it likely would not have not taken that step of reducing the value of those past losses as a way of eliminating future US taxes, according to Sullivan.</p><p><b>Is Tesla losing money at home?</b></p><p>There&#39;s another possible reason that Tesla might have reported a pre-tax loss on its US operations:—one that isn&#39;t as much an accounting maneuver designed to lower taxes as it is a warning sign about the viability of the company. Perhaps it still is losing money on the cars it is selling in the United States, and it can only make money using the lower costs of a relatively new factory in Shanghai, China.</p><p>That&#39;s what one of Tesla&#39;s most fervent critics and doubters believes. Gordon Johnson of GLJ Research, points out that Tesla was losing money overall until after it started producing cars in Shanghai in October 2019. He believes that investors are giving Tesla too much credit for profits in the US that he doesn&#39;t believe are real.</p><p>&#34;I think it&#39;s a massive deal,&#34; he said about Tesla&#39;s filing this week. &#34;They effectively said they don&#39;t plan on utilizing any of the net loss carry forwards. That means their US operations are losing money. It&#39;s an argument we&#39;ve made over and over again. Outside of China, Tesla loses money.&#34;</p><p>But other analysts who have examined its books insist Tesla&#39;s profits, both at home and overseas, are real, no matter what its US tax forms say.</p><p>Johnson said if he&#39;s wrong, it&#39;s up to Tesla to be more transparent.</p><p>&#34;The reality is, until they provide disclosure, both explanations could be right,&#34; he said.</p><p><b>Musk&#39;s rare big tax bill</b></p><p>Musk has a history of using the US tax code to pay little or no personal federal income taxes. A report from ProPublica shows that for 2018 Musk and many other Americans near the top of the world&#39;s richest people paid no income tax.</p><p>In Musk&#39;s case, he receives no salary from Tesla, only very valuable stock options, as a form of compensation. And under US tax code he doesn&#39;t have to pay taxes on those options until he exercises them to buy shares of stock at a fraction of their current value.</p><p>He also would have to pay taxes if he sells shares he already held because of his earlier investment in the company, which he has rarely done. But he did that last year as well.</p><p>Musk has not exercised most of the options that he holds. But he had options to buy 22.9 million shares that were due to expire in August 2022, and started exercising those options to buy additional shares late last year.</p><p>In total, he spent $142.6 million to purchase shares worth $23.6 billion, giving him $23.5 billion in in taxable income, taxable for 2021 at a federal rate of about 41%.</p><p>Musk also sold a small fraction of the additional shares he already owned, sales that fetched a taxable $5.8 billion at a lower capital gains rate.</p><p>Together those stock trades likely resulted in roughly an $11 billion federal tax bill, which he has tweeted about.</p><p>But that could well be the last time for years to come that he&#39;s paying a substantial federal tax,unless Congress passes one of the various proposals to tax the net worth of the nation&#39;s wealthiest individuals, rather than just their income. Gilead Sciences</h2><p>Drugmaker Gilead Sciences is trading at around $63 a share and has been inching closer to its 52-week low of $61.39. The stock nosedived after the company released its latest quarterly results on Feb. 1. Gilead&#39;s performance for the past three months of 2021 was underwhelming with the company&#39;s sales of $7.2 billion declining 2.4% from the same period a year ago. Net income of $376 million was also just a fraction of the $1.5 billion that it reported a year earlier; the healthcare company says the decline was largely due to a legal settlement of $625 million involving <b>Arcus Biosciences</b>.</p><p>For 2022, Gilead projects that its sales will come in between $23.8 billion and $24.3 billion; at the midpoint of $24 billion, that would be a decline of 12% from the $27.3 billion it recorded in 2021. The company expects diluted earnings per share (EPS) to be between $4.70 and $5.20 for the year, so it could still potentially come in better than the $4.93-per-share profit it reported this past year.</p><p>Even if there is a decline in profitability, those numbers will still be strong enough to support the company&#39;s dividend, which currently pays shareholders $2.92 per share a year. At the low point of its EPS estimate, Gilead&#39;s payout ratio would still be fairly modest at 62%; that would leave plenty of room for the company not only to support but also to grow its already high dividend, which currently yields 4.6%.</p><p>Although Gilead is facing some challenges, particularly from losses in exclusivity for some of its key products, the company is working on building out its pipeline. The company, which makes healthcare masks and respirators, was a popular investment during the pandemic&#39;s early stages. And as COVID-19 case numbers began to subside last year and hopes about a return to normal rose, interest in the stock began to wane.</p><p>The company released fourth-quarter numbers on Jan. 25, reporting sales of $8.6 billion for the period ended Dec. 31, 2021. That was flat from the prior year. Meanwhile, net income declined by 4.7% to $1.3 billion. By contrast, sales rose 5.8% in 2020&#39;s fourth quarter. That was largely due to an increase in safety and industrial revenue (including personal hygiene products and masks). This time around, however, that segment of its business fell 2% to about $3.1 billion.</p><p>Other business units (healthcare, transportation and electronics) are smaller and also showed little or no growth. The lone exception and growth catalyst in Q4 was its consumer business (e.g. bandages, cleaning, and stationery products) which rose by 4% and helped keep the quarter&#39;s sales just slightly above the prior-year numbers. All this diversification makes the business resilient -- and as a whole, 3M continues to do well. For all of 2021, net sales rose 10% year over year to $35.4 billion.</p><p>For income investors, the company&#39;s payouts look more than safe even if the growth rate starts to falter. 3M is a Dividend King thanks to increasing its dividend payments for more than 60 years in a row. And there&#39;s little doubt that streak will continue; it paid out $5.92 per share in dividends for 2021. With an EPS of $10.12, that puts its payout ratio at just 58%. So there&#39;s plenty of room for the company to continue making and increasing payouts.</p><p>3M shares haven&#39;t been this low since the fall of 2020, and the stock&#39;s yield is currently at 3.7%. It also allows customers to share and monetize their data, and the business is on track to benefit from a powerful network effect as more clients take advantage of these services.</p><p>A recent market study found that 100% of surveyed Snowflake customers recommend the company&#39;s services, and the data specialist&#39;s highly regarded offerings are paving the way for rapid business growth. It&#39;s also generally been challenging for companies that primarily operate in the Latin American market. As such, it&#39;s not shocking that <b>StoneCo</b> (NASDAQ:STNE) stock has struggled across the stretch, but the extent of the sell-offs has been staggering.</p><p>StoneCo is a leading provider of payment processing and other fintech services in Brazil. Berkshire Hathaway made a significant investment in the company when StoneCo had its initial public offering in 2018. The investment conglomerate started out owning a roughly 11% stake in the company, but it trimmed its position after shares went on to post explosive gains. Berkshire&#39;s decision to reduce holdings in StoneCo stock has proven to be a wise one given recent trading, but there&#39;s big comeback potential here.</p><p>Amid waning investor appetite for risk, high inflation, and economic uncertainty in Latin America, StoneCo stock has gotten pummeled. Shares trade down a staggering 85% from the lifetime high they hit last February.</p><p>StoneCo&#39;s outlook has been dampened due to new credit regulations in Brazil that have disrupted one of the company&#39;s growth vehicles. On the other hand, the fintech actually posted a record net customer addition of 294,000 new merchant clients in the third quarter, and it also added more than 420,000 new digital banking accounts in the period.</p><p>The company ended the quarter with nearly 1.4 million active payment clients, and total revenue climbed roughly 57% year over year in the period. Meanwhile, total payment volume conducted through StoneCo&#39;s platform was up roughly 54% after backing out contributions from pandemic-related stimulus initiatives. The company&#39;s net income also slumped roughly 54% in the period, largely due to the collapse of its credit business, but there&#39;s still a core growth engine here that looks pretty strong.</p><p>The big sell-offs have pushed StoneCo&#39;s market capitalization down to roughly $4 billion, and the company is now valued at roughly 30.5 times this year&#39;s expected earnings and 2.7 times expected sales.I believe this is a situation in which can benefit from being &#34;greedy when others are fearful,&#34; The analyst said: &#34;In our eyes, this growth appears to be in the early-to-mid stages of the growth curve, and with no signs of supply alleviating in the near term, it provides a nice backdrop for the gaming segment. On the data center side, we have heard from several companies that data center trends are very strong, which should benefit Nvidia.&#34;</p><p><b>Now what</b></p><p>In short, Piper Sandler is predicting that Nvidia will exceed expectations for 48% quarterly revenue growth and 58% earnings growth in its fourth-quarter report. But it&#39;s also predicting that the company will continue growing over the long term because the cyclical semiconductors industry is only in the early stages (or at worst, the middle) of its cycle of rising demand for chips, a cycle that should keep on growing for a few more years.</p><p>Assuming Piper is right, Nvidia is likely to comment on this trend in its earnings report tomorrow afternoon, and probably will raise guidance right after reporting on earnings.
