来源:NHTSA\n美国国家公路交通安全管理局(NHTSA)曾针对特斯拉“失控加速”展开调查,在历时一年之久的调查期后,NHTSA于2021年1月8日公布了相关的调查结果。调查显示,246例特斯拉失控加速事件,都是因为驾驶者错踩踏板造成的驾驶事故。这也意味着在车祸事件中,有人为操作失误的因素。\n为什么特斯拉的车辆容易操作失误?原因之一在于其单踏板模式,单踏板模式是通过电门踏板就能控制车辆的启动、加速、减速和停止,这样通过反向电流进行动能回收,就能达到节能并提高续航的目的。清研华科新能源研究院增材研发中心主任张抗抗表示,这种驾驶模式和燃油车相比,在人机交互方面发生变化,也更容易出现误操作。\n“现在张女士的事故已经找不出来真相了。”张翔告诉未来汽车日报,如果要解决的话,一种方式就是把数据传到第三方数据平台,一种是在车上装有行车记录仪,“但现在没办法追踪当时的现场的真相,这个事情已经无解了。”\n3\n谁才是“裁判员”?\n随着车主和特斯拉在维权过程中的推拉扯皮,解决问题的关键方向——行车数据权限及其责任判定——开始逐渐清晰。\n复盘整个维权始末,车主最初要求特斯拉公开数据,特斯拉拒绝了这个请求。在舆论压力下特斯拉公布了行车数据,但车主家属认为数据不充分,并指责特斯拉侵犯个人隐私,要求撤销数据,同时不接受特斯拉指定的第三方检测机构。\n事实上,“现在并没有权威的第三方检测机构能够检测智能汽车的交通事故责任问题”,张翔告诉未来汽车日报,对于传统燃油车来说,发生追尾撞车基本就是车主的责任,但是智能汽车在行驶过程中,高级辅助驾驶系统会参与开车,一旦发生发生事故,车企就要承担一定的责任。但目前来看,“国家还没有出台对带有自动驾驶功能的智能汽车的法律法规,车主与车企的责任很难厘清。”\n目前部分城市已经有了新能源行车数据记录平台,以上海为例,在该地区上牌的新能源汽车的数据都会被记录在上海市新能源汽车公共数据采集与检测研究中心。官方数据显示,截至目前,已经接入车辆的数量近42万辆,每辆汽车的发动机数据、报警数据以及电池数据等都能实时跟踪。\n\n“如果特斯拉想上传数据,应该是很简单的事,但他们并没有那么做。”张翔分析,目前特斯拉的自动驾驶技术在全球范围是领先的,但其软件系统也不算完善,容易出现BUG,数据一旦公开,外界就会很容易找到其漏洞。在他看来,特斯拉没有将数据上传至第三方平台,导致车企既是运动员又是裁判员,“自己管理数据然后再拿出来,无异于监守自盗,并没有公信力”。\n和燃油车可通过OBD接口获取行车辆信息不同,具备高级辅助驾驶功能的智能汽车需要对行车数据进行分析再应用。这很大程度上属于企业保密信息,普通车主很难获取。\n针对车主家属指责特斯拉侵犯个人隐私,太琨律创始合伙人朱界平律师告诉未来汽车日报,目前智能汽车数据的监管主体不明确,数据的真实性如何确定存在问题,另外智能汽车数据的确权以及权利的归属也没有明确的法律规定,“所以自动驾驶的数据归属,目前法律规定还不够明确”。\n朱界平表示,国家应强制车企将获取的数据进行不可修改的存储,或将形成的数据在至少两家以上的第三方机构存储,确保数据安全的目的在于合理、充分地使用数据。上海申伦律师事务所夏海龙也对未来汽车日报表达了同样的看法,其认为监管机构可以与车企探讨大数据的第三方托管和共享机制,通过不断提高大数据的利用效能,逐步明晰车主数据的采集规范。\n随着维权事件频发,智能汽车行业的监管漏洞也逐渐显现。此次特斯拉首次在国内公开行车数据,也凸显出厘清行车数据在智能汽车事故中责任的重要性。\n可以确定的是,特斯拉遭遇的问题并不是个案,安全性问题再怎么重视都不为过。而为了能使用户真正地放心体验、购买智能汽车,车企和行业需要做的还有很多。","news_type":1,"symbols_score_info":{"TSLA":0.9}},"isVote":1,"tweetType":1,"viewCount":2925,"authorTweetTopStatus":1,"verified":2,"comments":[],"imageCount":0,"langContent":"EN","totalScore":0},{"id":109629134,"gmtCreate":1619692911428,"gmtModify":1704728095413,"author":{"id":"3573474536021651","authorId":"3573474536021651","name":"ahbi","avatar":"https://static.tigerbbs.com/0536a833124fcc6fbe310b8fd1b87d1b","crmLevel":11,"crmLevelSwitch":0,"followedFlag":false,"authorIdStr":"3573474536021651","idStr":"3573474536021651"},"themes":[],"htmlText":"Nice","listText":"Nice","text":"Nice","images":[],"top":1,"highlighted":1,"essential":1,"paper":1,"likeSize":1,"commentSize":1,"repostSize":0,"link":"https://ttm.financial/post/109629134","repostId":"1170908014","repostType":4,"repost":{"id":"1170908014","kind":"news","weMediaInfo":{"introduction":"为用户提供金融资讯、行情、数据,旨在帮助投资者理解世界,做投资决策。","home_visible":1,"media_name":"老虎资讯综合","id":"102","head_image":"https://static.tigerbbs.com/8274c5b9d4c2852bfb1c4d6ce16c68ba"},"pubTimestamp":1618906754,"share":"https://ttm.financial/m/news/1170908014?lang=en_US&edition=fundamental","pubTime":"2021-04-20
