$Twitter(TWTR)$ is the most talked of stock of the day due to its impending legal fight with Elon Musk.   At stake is USD 44 billion acquisition deal at a takeover price of USD54.20 per share.  There is a massive difference compared to its latest closing price today at USD36. 29.

Who will win the legal case?   This is really hard to say as it is the largest deal to land in court todate.  Morally, Twitter is on high ground as it was Elon Musk who courted Twitter to sell to him in April and then changed his mind. 

After 3 months of high drama, Twitter's share price has fallen dramatically.  Some employees lost their jobs and overall the morale is low.  Twitter's shareholders especially the small investors are staring at a massive loss in their Twitter's share holdings.

I believe Elon Musk should pay the USD 1 billion break up fee.  It is the very least he can do in the light of the massive upheaval he caused in Twitter. 

Ultimately the best solution for both Elon Musk and Twitter is to settle the case amicably by Elon Musk paying the USD 1 billion break up fee plus legal costs.  Or for Elon Musk to renegotiate with Twitter to acquire Twitter at a lower cost. 

It is a No Win situation if the legal battle drags on for both parties.  The only winners will be the lawyers. 

So my message to Elon Musk and Twitter is just 1 word - "Settle"!

Will Elon Musk Pay for Twitter Breakup Fee?
Twitter will battle Musk in an elongated court battle to recoup the deal and/or the breakup fee of $1 billion at minimum. Will Musk pay for it?
